<p>It’s Independence Day! The 4th of July! Burgers! Picnics! Fireworks!</p>
<p>That’s what it’s all about, right? Go, America!</p>
<p>Actually, no, there probably weren’t any hotdogs cooking on the grill on Independence Day in 1776. When the founding fathers of our nation signed the <a title="http://www.amazon.com/gp/product/1557094489/ref=as_li_tl?ie=UTF8&camp=1789&creative=390957&creativeASIN=1557094489&linkCode=as2&tag=rev0303-20&linkId=7KN7XFPJXPXDBEIT" href="http://www.amazon.com/gp/product/1557094489/ref=as_li_tl?ie=UTF8&camp=1789&creative=390957&creativeASIN=1557094489&linkCode=as2&tag=rev0303-20&linkId=7KN7XFPJXPXDBEIT" target="_blank">Declaration of Independence</a>, they probably weren’t wondering if the beer was cold yet, if Ben was going to burn the burgers again, or whether Thomas remembered the lighter for the fireworks.</p>
<p>They were thinking about freedom.</p>
<p>The whole purpose of the gesture was that these men were tired of bowing down to someone who did not have their best interests at heart. They were determined to no longer be the subjects of a King who looked at them as a way to make himself wealthy.</p>
<p>And, sadly, here we are a couple hundred years later, dependent yet again.</p>
<p>Our culture is just so incredibly dependent. <strong>Freedom is terrifying to most people because it means that they and they alone, are responsible for the actions that they take.</strong> An independent person succeeds or fails on his or her own merit. Independence by its very nature means that the possibility of failure exists. It requires a sense of adventure, confidence, and the ability to fail and get right back up again, and it seems like these things are being bred out of the American people.</p>
<p>What “independence” actually means</p>
<p>“Independent”, by definition, is the opposite of dependent. Here’s a whole list of <a title="http://dictionary.reference.com/browse/independent?s=t" href="http://dictionary.reference.com/browse/independent?s=t" target="_blank">definitions</a>:</p>
<blockquote class="typ1"><p>1. not influenced or controlled by others in matters of opinion, conduct, etc.; thinking or acting for oneself.<br/>2. not subject to another’s authority or jurisdiction; autonomous; free<br/>3. not influenced by the thought or action of others.<br/>4. not dependent; not depending or contingent upon something else for existence, operation, etc.<br/>5. not relying on another or others for aid or support.<br/>6. rejecting others’ aid or support; refusing to be under obligation to others.<br/>7. possessing a competency.</p>
</blockquote>
<p>So, if you are, at heart, a free person, the above is the description of your character.</p>
<p>Maybe you read that list and realized it doesn’t describe you. With some hard work and a big dose of courage, it can. Here’s how:</p>
<p><strong>You must reduce your dependence on everything that is out of your control.</strong></p>
<p>You must reduce your dependence on the government, the large corporations, the transportation system, money, the banking system, entities like the FDA and the USDA. All of these are marketed to us to make it seem like we can’t survive without them.</p>
<p>Those who signed the Declaration of Independence, hundreds of years ago, knew this was the case. When Britain tried to coerce them and convince them that they needed help and governance from the other side of the ocean, those patriots decided that there was not one single thing that England could provide for them that they needed enough to remain under the rule of the King.</p>
<p>Once you decide that there’s nothing that you need, then the boogeymen who would control us all lose their power. That’s why nearly everything you need to do to become self-sustaining is either illegal or strongly discouraged: milk straight from the cow, water collection, front-yard vegetable gardens, carrying a firearm. They need you to need them.</p>
<p><span class="BoldGrey">How we’re manipulated into dependence</span></p>
<p>The government is not really made up of the elected officials that it purports. <strong>It’s made up, mostly, by people who sell their souls to huge corporations that have an interest in beneficial laws being passed and laws that would harm their businesses shut down before they ever reach the desk of the presidents.</strong></p>
<p>As well, the supposed watchdog entities, like the Food and Drug Administration, the Environmental Protection Agency, and the United States Department of Agriculture are also <strong>populated by those who have been hand-picked to support corporations, no matter what the detriment to the American people whom they pretend to protect.</strong> If Congress was like Nascar, the members would have to wear uniforms emblazoned with their sponsors. However, Washington DC does not have the transparency of professional car racing, so we must guess at the sponsors of our members.</p>
<p><strong>We are buried under silly laws with the sole purpose of generating revenue or adding to the slave labor force in the for-profit prison system.</strong> We must work most of our waking hours to be able to pay for our basic necessities. We are convinced repeatedly that we must have things that our ancestors would never have considered owning, much less requiring.</p>
<p>Hand in hand, the mega-corporations and the government entities work together to keep us subservient and in our places. The corporations create products, the watchdog agencies “test” the products, and the government mandates an artificial need for these products.</p>
<p>They have most people convinced that they must follow the food pyramid, the vaccine schedule, and the rules that force us to have licenses for every darned thing we do. We must pay for and be granted permission to feed ourselves, transport ourselves, build shelter for ourselves, unite in matrimony, and even to own pets.</p>
<p><strong>Like some kind of frighteningly authoritarian parent, they assure us that it’s for our own safety, these breaches in our independence, and that we must comply or face the consequences.</strong> They ground us by taking away our licenses. They send us to our rooms that just happen to be located in for-profit prisons. They don’t “allow” us to pursue life, liberty, and happiness because once we taste that sweet freedom, we won’t want to be under their oppressive thumbs anymore.</p>
<p>But some of us have seen the corporate government for what it is: a bully that reigns through fear of reprisal. They hold over us these fears:</p>
<blockquote class="typ1"><ul>
<li>We will die if we don’t eat things that were inspected and approved by them.</li>
<li>We will be jailed, fined, or have our children taken from us if we don’t toe the line.</li>
<li>We are unable to figure things out for ourselves because we are not “experts” and therefore we must suppress our own judgments and bow to their far greater knowledge.</li>
<li>We will die if we don’t follow their expert health and nutrition advice.</li>
<li>We’ll be murdered by scary foreign terrorists if we don’t allow the TSA to fondle our private parts and perform x-rays that show us naked before we fly.</li>
</ul>
</blockquote>
<p>Because some people fear these things and believe these tales so thoroughly, they allow the government to enforce ridiculous, unconstitutional laws “for our own safety.” They say, “Better that I give up my rights as a human being and save the world from a terrorist.” They justify, “These agents are only doing their jobs.” Heck, I’ve even heard people in line at the airport thank the TSA for patting them down.</p>
<p>Whether you call it freedom, liberty, sovereignty, or self-governance, the point remains the same: if you’re reading this, you probably want to determine your own life, whether the result is success or failure. You want to have control over your ability to live,truly live, and not merely exist as a slave to the powers that be.</p>
<p><span class="BoldGrey">How we’re all being manipulated by the corporate government</span></p>
<p>The corporate system is constructed around making us feel as though we need what they are offering. They want us to believe we need their expertise, their handouts, their approvals, and their protection. They want us to feel that we are not capable of making our own decisions without their input.</p>
<p><strong>Once they create this insecurity in you, then you have become their slave.</strong></p>
<p>You must work, almost non-stop, to be able to afford the lifestyle they tell you to have. Your home must meet their standards, your dependence upon the grid is absolute, and you must never, ever partake of a food that has not passed their approval process. You should call the experts to protect you, via 911, as opposed to taking care of your own security. Your children must be supervised constantly, unable to <a title="http://www.theorganicprepper.ca/the-last-rebels-25-things-we-did-as-kids-that-would-get-someone-arrested-today-06162015" href="http://www.theorganicprepper.ca/the-last-rebels-25-things-we-did-as-kids-that-would-get-someone-arrested-today-06162015" target="_blank">grow and seek adventures</a>, in order to create the next generation of adults who submit without even realizing they are doing so.</p>
<p>When it’s put like that, you can see how absolutely ridiculous it all is, right?</p>
<p>Let’s take food, for example.</p>
<p>Historically, in nearly every takeover of the modern world, food was involved. Think of communist China in the early 1960s or <a title="http://www.amazon.com/gp/product/0393304167/ref=as_li_tl?ie=UTF8&camp=1789&creative=390957&creativeASIN=0393304167&linkCode=as2&tag=rev0303-20&linkId=XBFUVMI4M7GZCM7G" href="http://www.amazon.com/gp/product/0393304167/ref=as_li_tl?ie=UTF8&camp=1789&creative=390957&creativeASIN=0393304167&linkCode=as2&tag=rev0303-20&linkId=XBFUVMI4M7GZCM7G" target="_blank">the Holodomor</a>, for two examples. The government took control of the farms “for the good of the people.” They controlled all of the food – every single bite. If you complied, you ate. If you rebelled, you starved.</p>
<p>Here’s another example. Back 100 years ago, people drank milk. You got it from cows as opposed to the store. Now, the substance they drank is called “raw milk” and it’s the subject of taboos, warnings, and legal hoops that must be jumped through. It’s a million times easier to purchase a known carcinogen (cigarettes) or a mood-altering substance (alcohol) than it is to get fresh, creamy milk from a cow and drink it. We’ve been brainwashed into believing our milk must be heated to the point that the good bacteria is exterminated and then approved by the USDA before we’re able to drink it. Milk is controlled like a dangerous Level 1 narcotic, for crying out loud. But pasteurized milk from the store, originated from cows that were given recombinant bovine growth hormone and antibiotics, is perfectly fine. It’s USDA approved.<br/><strong>In a million small ways, folks are being brainwashed that we require permission to do nearly everything</strong>. Think of an abusive relationship, because our relationship with the government is a classic example of such a thing.</p>
<p>The abuser says things like this to the victim:</p>

<li>“You’d never survive without me.”</li>
<li>“You obviously need me to take care of you because you aren’t smart enough to take care of yourself.”</li>
<li>“Why did you do that without my permission? Now, you’re going to be punished.”</li>
<li>“I’m doing this for your own good.”</li>
</ul>
</blockquote>
<p>The abuser keeps track of your time, makes you account for your earnings, seizes your personal belongings, coerces you into doing things you don’t want to do, and harshly discourages any vestiges of independence. Because if you are independent, they have lost control of you. Compliance is rewarded and rebellion is punished.</p>
<p>Let the TSA pat you down, you are allowed to travel. Refuse to be groped and you lose the price of your plane ticket and your opportunity to go to your cousin’s wedding by air. Sell a homemade edible product that hasn’t been “inspected” and approved by local officials, they will fine your business out of existence. Not only this, but occasionally we’re allowed to feel we’re independent and do these things, and we pay extra for the privileges for living our lives, traveling, and earning a living.</p>
<p><span class="BoldGrey">So how do you become an independent human being?</span></p>
<p>You may feel like you aren’t in the right place in life to declare your independence. Perhaps you don’t have room to raise your own food. Perhaps you have a physical handicap that bars you from living 30 miles from civilization in a yurt located down a dirt road, over a creek, and in the woods. Maybe it’s all you can do financially to keep the refrigerator full of groceries for the week.</p>
<p>But wherever you are right now, that’s okay. Wherever you are, know that every single person, even the very free-est person you know, started at a place that was less free than where they are right now. <strong>The most important thing is to begin to recognize the chains that are on you so that you can begin, link by link, to break them.</strong></p>
<p>How do you break free of the life that nearly every single person around you lives?</p>
<p>It’s simple, yet so complicated. Here it is, the ultimate act of insurrection:</p>
<p>You have to need less.</p>
<p>When you need less, you have less to fear.</p>
<p>Now, every year when I write about this topic, a few people come out of the woodwork to claim, “It’s not enough.” Not everyone is a warrior, but taking steps to become freer than you were the day before is a cause for celebration.</p>
<p>It is simply reality that most of us cannot make a stand in every single aspect of our lives. We have children that could be taken away from us. We have homes that could be seized. We fear being imprisoned in a cage. I get that, truly. I don’t want to lose my daughter or my home or be thrown in jail either. The folks in control have done their job in that respect, but we can work around it.</p>
<p><strong>We can refuse to eat the poisoned apple that they graciously hand to us. Some can stop sending their children to public school for “free” education. We can all stop purchasing processed food that originated as the bastard child of factory farming and a chemistry project.</strong> We can refuse to shop at Wal-Mart, K-mart, or any of those corporate discount stores that have their products manufactured in sweat shops so that they can undercut the Mom & Pop stores right out of business.</p>
<p>I use well water and hope to soon install some solar panels. I raise as much food as I can and I buy the stuff I can’t raise from farmer friends who treat their animals well. I don’t watch television and haven’t seen a commercial in more than a year, so I’m not really sure what it is I “need”. I buy things I actually do need from local craftsmen and I have things repaired instead of replaced. I don’t pay interest to the banks, heck – I don’t even leave money in the bank. 911 is not my default for home security. We don’t have Obamacare, cable TV, a major credit card, or a home phone. I live my life quietly, and without many of the things that others consider “necessities.”</p>
<p>You might be thinking, “What about the children? Don’t they feel deprived?”</p>
<p>I don’t believe that they do. My oldest daughter just graduated from college, debt free. We budgeted carefully, she won scholarships, and she gets to start her life without being in the hole. She can take her time and travel to Europe before she gets a “real” job, because she doesn’t have a student loan hanging over her head that requires her to dive into full time permanent servitude right now.</p>
<p>My youngest daughter stays up until midnight and sleeps until noon all year round, because she is not subject to school bells at specific times. Her grades are very good, and she has far more free time than her public-schooled friends. She takes care of horses, dogs, and cats. She actually earns a substantial amount of money shoveling poop for people who don’t have the time to do so. For fun, she hikes and shoots her long bow. She meets up with other home-schooled kids to hang out because they aren’t tied to an arbitrary schedule either.</p>
<p>I spend my mornings outside with the animals. I check on the vegetable garden and see if there will soon be something to harvest. Instead of an iPod, my music is the birds, the wild turkeys, the friendly nicker of the horses, hoping for some attention. I spend my days learning: about health, nutrition, natural remedies, old methods of gardening and preservation, and needlecraft. I read the books I always wanted to read. We don’t spend a lot of money and that decreases a great deal of our need for money. I don’t have to sell the majority of the hours in my day for enough money to survive the other hours.</p>
<p>Every single day, I strive to reduce my vulnerability to coercion. Because the less I need, the more difficult I am to manipulate.</p>
<p>And you? You don’t need this stuff they are offering, either. There is so much that you can do to free yourself from them….</p>

<p style="text-align: left;">For the past few days this writer has watched news of the <a class="inline_link omniture-click-processed" href="http://www.examiner.com/topic/scandal">scandal</a> surrounding mismanagement of the <a class="inline_link omniture-click-processed" href="http://www.examiner.com/topic/va-hospital">VA Hospital</a> System percolate.</p>
<p><br/> For those still unaware, 40 Veterans are alleged to have died as a result of unacceptably long delays in seeing a doctor and/or receiving Medical Treatment. Only upon the discovery of documentation verifying attempts to cover up, and/or understate the length of the delays, has the Obama Administration decided that ignoring or denying the scandal would no longer work.<br/> <br/> Yesterday, President Obama finally had a press conference at which he addressed the scandal and said that such mismanagement would not be tolerated.<br/> <br/> That having been said, lets back the truck up.<br/> <br/> Before Obamacare, aka the <a class="inline_link omniture-click-processed" href="http://www.examiner.com/topic/affordable-care-act">Affordable Care Act</a> (<a class="inline_link omniture-click-processed" href="http://www.examiner.com/topic/aca">ACA</a>), ever was passed many persons pointed to mismanagement of the VA Hospitals as evidence the Federal Government was incapable of properly managing healthcare for the entire nation. In response, many Democrats denied the allegations of bad management at the VA Hospitals, and some even pointed to the excellent management of the VA Hospitals as evidence that Government could manage all of the nation's healthcare.<br/> <br/> Essentially the proponents of Obamacare shouted down the factual evidence that the Government was failing in its management of healthcare for Military Veterans;Veterans who should receive the best care possible. This factual evidence showed that the Government could not even properly manage the health of a very small fraction of the nations entire population.<br/> <br/> But those us of familiar with the VA Hospitals' long history of mismanagement and cover up, knew better.<br/> <br/> This writer repeatedly tweeted and emailed a link to a film clip of a 1992 movie called Article 99. This movie was directly on point to the issue of mismanagement that comes with government involvement with healthcare. In this instance, in the very VA Hospitals now embroiled in the current scandal.<br/> This is the Tweet this writer currently periodically sends out on Twitter @DMashak.</p>

<p>Though the wording has change slightly since before Obamacare was passed, the video and the link remain the same as the one this writer posted many times before the passage of Obamacare. Obamacare was signed by President Barrack Obama on June 25, 2010. <br/>The Obama administration has won the latest battle in their fight to indefinitely detain US citizens and foreigners suspected of being affiliated with terrorists under the National Defense Authorization Act of 2012.</div>

<p>Congress granted the president the authority to arrest and hold individuals accused of terrorism without due process under the <a href="http://rt.com/trends/national-defense-authorization-act-indefinite-detention/" target="_blank">NDAA</a>, but Mr. Obama said in an accompanying <a href="http://rt.com/usa/obama-detention-ndaa-aclu-303/" target="_blank">signing statement</a> that he will not abuse these privileges to keep American citizens imprisoned indefinitely. These assurances, however, were not enough to keep a group of journalists and human rights activists from filing a federal <a href="http://rt.com/usa/obama-hedges-ndaa-sued-933/" target="_blank">lawsuit</a> last year, which contested the constitutionality of Section 1021, the particular provision that provides for such broad power.</p>
<p>A federal judge <a href="http://rt.com/usa/ndaa-judge-obama-forrest-295/" target="_blank">sided</a> with the plaintiffs originally by granting an injunction against Section 1021, prompting the Obama administration to request an <a href="http://rt.com/usa/obama-indefinite-detention-forrest-070/" target="_blank">appeal</a> last year. On Wednesday this week, an appeals court in New York ruled in favor of the government and once again allowed the White House to legally indefinitely detain persons that fit in the category of enemy combatants or merely provide them with support.</p>

<p>Now with this week’s appellate decision, plaintiffs intend on taking their case to the Supreme Court. Should the high court agree to hear their argument, the top justices in the US may finally weigh in on the controversial counterterrorism law.</p>
<p>The so-called “indefinite detention” provision of last year’s National Defense Authorization Act has been at the center of debate since before President Barack Obama autographed the bill in December 2011, but a federal lawsuit filed by Pulitzer Prize-winning war correspondent Chris Hedges and others only two weeks after it went into effect remains as relevant as ever in light of a decision delivered Wednesday by the US Court of Appeals for the Second Circuit.</p>

<p>The plaintiffs in case had previously been successful in convincing a federal district judge to keep Section 1021 from being put on the books, but the latest ruling negates an earlier injunction and once again reestablished the government’s right to indefinitely detain people under the NDAA.</p>
<p>Tangerine Bolen, a co-plaintiff in the case alongside Hedges, told RT, “<i>Losing one battle is not losing the war. This war is an assault on truth itself. It flaunts reason, sanity and basic decency. We will not stand down in the face of these egregious assaults on our rights and liberties</i>.”</p>
<p>In a statement published to TruthDig, Hedges called the ruling “<i>distressing</i>” and said, “<i>It means there is no recourse now either within the Executive, Legislative or Judicial branches of government to halt the steady assault on our civil liberties and most basic Constitutional rights</i>.”</p>
<p>Section 1021 of the NDAA reads in part that the president of the US can indefinitely imprison any person who was part of or substantially supported al-Qaeda, the Taliban or associated forces engaged in hostilities against the US or its coalition partners, as well as anyone who commits a "<i>belligerent act</i>" against the US under the law of war, "<i>without trial, until the end of the hostilities</i>.” The power to do as much was allegedly granted to the commander-in-chief after the Authorization to Use Military Force was signed into law shortly after the September 11, 2001 terrorist attacks, but a team of plaintiffs have argued that Section 1021 provides the White House with broad, sweeping powers that put the First Amendment-guaranteed rights to free speech and assembly at risk while also opening the door for the unlawful prosecution of anyone who can be linked to an enemy of the state.</p>
<p>Only two weeks after the 2012 NDAA was signed into law, Hedges filed a lawsuit against the Obama administration challenging the constitutional validity of Section 1021.</p>
<p>“<i>I have had dinner more times than I can count with people whom this country brands as terrorists … but that does not make me one</i>,” he said at the time.</p>
<p>Naomi Wolf, an American author, told the Guardian last year that she has skipped meetings with individuals and dropped stories that she believed are newsworthy “<i>for no other reason than to avoid potential repercussions under the bill</i>.”</p>

<p>Hedges first filed suit on Jan 13, 2012, and was eventually joined by a number of activists, reporters and human rights workers from both the US and abroad, including Pentagon Papers leaker Daniel Ellsberg, journalist Alexa O’Brien, Revolution Truth founder Bolen and Icelandic PM Birgitta Jónsdóttir. District Court Judge Katherine Forrest granted the plaintiffs a preliminary injunction against Section 1021 that May, only to make that decision permanent four months later. The Obama administration filed a stay against that injunction just days after, though, and the appeals court ruled this week that Judge Forrest’s decision must be vacated.<br/><br/> Carl Mayer, an attorney for the plaintiffs, <a href="http://rt.com/usa/supreme-court-ndaa-indefinite-016/" target="_blank">previously told RT</a> that he expected the White House to lose the appeal. “<i>The Obama administration has now lost three times. They lost the temporary injunction, they lost the motion for reconsideration and they lost the hearing for permanent injunction. I say three strikes and you’re out</i>,” he said.<iframe width="640" height="360" src="http://www.youtube.com/embed/25EWUUBjPMo?feature=player_embedded&wmode=opaque" frameborder="0"></iframe>

<p>But with the court’s 3-0 ruling this week, a federal panel concluded that the plaintiffs involved in the suit do not have standing to challenge Section 1021. In doing so, however, they offered what is the most official interpretation yet of a law that has continuously attracted criticism for nearly two years now.</p>
<p>After years of debate, the appeals court said once and for all that the NDAA does not apply to American citizens, and rehashed the Obama administration’s insistence that it simply reaffirmed rights afforded to the government through the AUMF.</p>
<p>“<i>Section 1021(e) provides that Section 1021 just does not speak — one way or the other — to the government’s authority to detain citizens, lawful resident aliens or any other persons captured or arrested in the United States</i>,” the court ruled.</p>
<p>“<i>We thus conclude, consistent with the text and buttressed in part by the legislative history, that Section 1021 means this: With respect to individuals who are not citizens, are not lawful resident aliens and are not captured or arrested within the United States, the President’s AUMF authority includes the authority to detain those responsible for 9/11 as well as those who were a part of, or substantially supported, al-Qaeda, the Taliban or associated forces that are engaged in hostilities against the United States or its coalition partners — a detention authority that Section 1021 concludes was granted by the original AUMF</i>.”</p>
<p>“<i>But with respect to citizens, lawful resident aliens, or individuals captured or arrested in the United States, Section 1021 simply says nothing at all</i>,” it concluded.</p>
<p>The AUMF, however, is still open to interpretation. An earlier legal ruling concluded that the AUMF “<i>clearly and unmistakable</i>” authorized detaining those who were “<i>part of or supporting forces hostile to the US</i>.” Then a memo issued in March 2009 just weeks’ into Pres. Obama’s first term even added that the government has the authority “<i>to detain persons who were part of or substantially supported</i>” anyone engaged in hostilities against US or its partners.</p>
<p>“<i>In any event, the March 2009 Memo took the view that ‘the AUMF is not limited to persons captured on the battlefields of Afghanistan’ nor to those ‘directly participating in hostilities</i>,’” the appeals court noted. When the DC Circuit weighed in further down the road, it determined that the AUMF authorized detention for those who “<i>purposefully and materially support</i>” those hostile forces, although this week’s ruling makes note that the Circuit Court has failed to ever figure out what “<i>support</i>” exactly means.</p>
<p>“<i>The government contends that Section 1021 simply reaffirms authority that the government already had under the AUMF, suggesting at times that the statute does next to nothing at all. Plaintiffs take a different view</i>,” wrote the court this week.</p>
<p>Definitions aside, however, the appeals court wrote that Hedges and his American co-plaintiffs lack standing to challenge the indefinite detention provisions since a subsection of that rule, 1021(e), frees US citizens from detention under the NDAA.</p>
<p>“<i>We recognize that Section 1021 perhaps could have been drafted in a way that would have made this clearer and that the absence of any reference to American citizens in Section 1021(b) led the district court astray in this case. Perhaps the last-minute inclusion of Section 1021(e) as an amendment introduced on the floor of the Senate explains the somewhat awkward construction</i>,” wrote the court. “<i>But that is neither here nor there. It is only our construction, just described, that properly gives effect to the text of all of the parts of Section 1021 and thus reflects congressional intent</i>.”</p>
<p>At the same time, though, the appeals court acknowledged that Iceland’s Jónsdóttir, co-plaintiff Kai Wargalla of Germany and other foreign persons could be detained indefinitely under the NDAA. Although Jónsdóttir has argued that her well-documented affiliation with the anti-secrecy group WikiLeaks — particularly with regards to classified material its published much to the chagrin of the US government — is enough to land her in hot water, the court said indefinite imprisonment in a military jail cell is an unrealistic fear and she therefore lacks standing.</p>
<p>Jónsdóttir, 46, has been a member of the Iceland parliament since 2009, the same year that US Army Private first class Bradley Manning began supplying materials to WikiLeaks. Jónsdóttir and WikiLeaks founder Julian Assange worked directly with raw video footage supplied by Manning showing a US helicopter fatally wounding innocent civilians and journalists, which the website later released under the name “Collateral Murder.” And although Pfc. Manning is <a href="http://rt.com/usa/bradley-manning-defense-benkler-921/" target="_blank">currently on trial</a> for “aiding the enemy” by supplying WikiLeaks — and indirectly al-Qaeda — with that intelligence, the court said Jónsdóttir herself has nothing to fear.<iframe width="640" height="360" src="http://www.youtube.com/embed/25EWUUBjPMo?feature=player_embedded&wmode=opaque" frameborder="0"></iframe>
</p>
<p>“<i>The claims of Jónsdóttir and Wargalla stand differently. Whereas Section 1021 says nothing about the government’s authority to detain citizens, it does have real meaning regarding the authority to detain individuals who are not citizens or lawful resident aliens and are apprehended abroad</i>,” the court ruled.</p>
<p>Elsewhere, the judges wrote that the government insists that WikiLeaks and Manning provided “<i>some support</i>” to hostile forces by publishing classified intelligence, and that the 25-year-old Army private is indeed facing prosecution for such that could put him away for life.</p>
<p>“<i>One perhaps might fear that Jónsdóttir’s and Wargalla’s efforts on behalf of WikiLeaks could be construed as making them indirect supporters of al-Qaeda and the Taliban as well</i>,” wrote the court. “<i>The government rejoins that the term ‘substantial support’ cannot be construed so in this particular context. Rather, it contends that the term must be understood — and limited — by reference to who would be detainable in analogous circumstances under the laws of war</i>.”</p>
<p>Because “<i>plaintiffs have provided no basis for believing that the government will place Jónsdóttir and Wargalla in military detention for their supposed substantial support</i>,” the court has rejected their lawsuit.</p>
<p>“<i>In sum, Hedges and O’Brien do not have Article III standing to challenge the statute because Section 1021 simply says nothing about the government’s authority to detain citizens</i>,” concluded the court. “<i>While Section 1021 does have meaningful effect regarding the authority to detain individuals who are not citizens or lawful resident aliens and are apprehended abroad, Jónsdóttir and Wargalla have not established standing on this record. We vacate the permanent injunction and remand for further proceedings consistent with this opinion</i>.”</p>
<p>Meanwhile, the court’s decision did little to resolve what actually is allowed under the AUMF. In fact, the court said Section 1021 “<i>does not foreclose the possibility that previous 'existing law' may permit the detention of American citizens</i>,” making note of American Yaser Esam Hamdi and a three-year ordeal that left him without the right to habeas corpus or an attorney after he was picked up in post-9/11 Afghanistan on suspicion of terroristic ties. Instead, it confirmed that foreign citizens engaged with substantially supporting hostile forces— neither of which term is still properly defined — can be locked up in military jails.</p>
<p>Hedges <a href="http://rt.com/usa/ndaa-reddit-plaintiffs-hedges-143/" target="_blank">previously said</a> that he thought that the US was already using the NDAA to put some people away.</p>
<p>“<i>If the Obama administration simply appealed it, as we expected, it would have raised this red flag</i>,” Hedges said during an online Q-and-A session on Reddit when the White House last fought back. “<i>But since they were so aggressive it means that once Judge Forrest declared the law invalid, if they were using it, as we expect, they could be held in contempt of court. This was quite disturbing, for it means, I suspect, that US citizens, probably dual nationals, are being held in military detention facilities almost certainly overseas and maybe at home</i>.”</p>
<p>In a statement published to TruthDig on Wednesday, Hedges said that he plans to appeal. If accepted, the case of <i>Hedges v Obama</i> may go all the way to the Supreme Court. That’s a decision that will weigh with the justices, however, and Hedges said they are by no means required to hear their request.</p>
<p>“<i>It is a black day for those who care about liberty</i>,” wrote Hedges.</p>
<p>In her statement to RT, Bolen rejected the notion that she and others lack standing to challenge a law that plaintiffs believe is being used in secrecy.</p>
<p>“<i>Good people have come forward to challenge the madness of the US government in the wake of 9/11 - people who have every reason to fear this atrocious panoply of laws and policies that are fundamentally eroding guaranteed liberties and basic human rights</i>,” she said.</p>
<p>“<i>The United States Government itself is behaving as a terror. Through indefinite detention of innocent civilians at Guantanamo, secret rendition, torture, murder of hundreds of thousands of innocent civilians in Iraq and illegal drone bombings - it is fundamentally eroding the rule of law while harming national security. <p>What many had assumed would be a meeting regarding New York State Sheriffs’ Association concerns about New York’s strict new gun laws, turned into a verbal scolding from the Governor which included the threat of some people’s jobs if they didn’t toe the line and shut up about the SAFE Act.</p>
<p>Via the <a href="http://www.timesunion.com/local/article/Sheriffs-Cuomo-asked-for-silence-4532930.php">Times Union</a>:</p>
<blockquote><blockquote><p>The sheriffs thought they were being summoned to the Capitol to discuss ideas for changes to New York’s gun control law, the SAFE Act. Instead, Gov. Andrew Cuomo told them to keep quiet.Opposition to the new law has simmered in upstate areas since Cuomo signed the law in January. Many county sheriffs oppose it, particularly its expanded definition of banned assault weapons, and have spoken out around the state. In January, the New York State Sheriffs’ Association wrote Cuomo with an analysis, and later suggested tweaks.</p>
<p>Cuomo invited its leaders to the Capitol last month, people briefed on the meeting said.</p>

<p>Rather than discuss the merits of the letter, Cuomo asked those in attendance to stop publicly discussing opposition to the SAFE Act.</p>
<p>One individual briefed on the meeting claimed that Cuomo had threatened to remove some sheriffs from office.</p>
<p>What has raised the ire of the Governor is a lawsuit the Association has joined in, challenging the Constitutionality of the SAFE Act.</p>
<p>Via <a href="http://www.empirestatenews.net/News/20130520-4.html">Empire State News</a>:</p>
<blockquote><p>The New York State Sheriffs’ Association has joined as amicus curiae in a lawsuit brought by the New York State Rifle and Pistol Association challenging the constitutionality of several provisions of SAFE Act. Sheriff Maciol has been a member of the NYS Sheriff’s Association since taking office as Sheriff in 2011, serves on many of their committees, and is currently serving as the association’s Sergeant at Arms.</p>
<p>The amicus brief will support the main suit by setting forth legal arguments against the SAFE Act specifically from the view of law enforcement. Some of the arguments contained in the brief are that the law impinges upon the 2nd Amendment to a degree that renders it unconstitutional, that the law is fatally vague, and that the law does not provide sufficient guidance to law enforcement.</p>

<p>Much as he did when ramming the gun legislation through in January by avoiding a three-day public screening, Governor Cuomo is simply trying to silence opposition.</p>
<p>Silencing opposition is a good way to flesh out one’s Democrat credentials for national office, no doubt. If his presidential aspirations fall through, there may be a position available for Cuomo at the IRS.</p>
