<p>Represented by an extremist nonprofit that lists conservative organizations on a catalogue of “hate groups,” seven illegal immigrants detained in a workplace raid are suing the federal agents that arrested them, claiming that they were racially profiled for being Latino. In a federal court complaint filed this week by their pro bono attorneys at the Southern Poverty Law Center (SPLC), the illegal aliens assert that Immigration and Customs Enforcement (ICE) agents violated their Constitutional rights against illegal seizures and to equal protection under the Fourth and Fifth Amendments to the U.S. Constitution.</p>
<p>The raid occurred last spring at a slaughterhouse and meatpacking plant in a small rural town called Bean Station in east Tennessee. Agents from ICE and the Internal Revenue Service (IRS) raided the facility as part of a lengthy investigation into the owner’s multi-million-dollar tax evasion and fraud scheme. About 100 illegal aliens were arrested, most of them from Guatemala and Mexico and some had been previously deported from the U.S. more than once. At least 54 people were deported immediately, some were released and others faced federal or state charges, according to a local news report following the seize.</p>
<p>The owner of the business, James Brantley, eventually pled guilty to multiple federal crimes, including tax fraud, wire fraud, and employment of unauthorized illegal aliens. The feds say he avoided paying nearly $1.3 million in taxes by hiring at least 150 illegal aliens and paying them off the books in cash. The scheme began in 1988 and continued through 2018 when he got busted. Brantley had reported to the IRS that he had only 44 wage-earning employees, according to the Department of Justice (DOJ). To avoid Federal Insurance Contributions Act (FICA) tax obligations, unemployment insurance premiums, unemployment tax and workers’ compensation insurance premiums he paid illegal immigrants in cash at a rate of $8-$10 per hour.</p>
<p>The feds said it was a criminal investigation from day one, not simply an immigration enforcement action as many open borders activists alleged. “Tax fraud is an outrage to hard-working Americans directly harmed when criminals cheat their obligation to society by failing to pay their fair share, and the employment of illegal workers also poses a serious threat to public safety as the use of fraudulent identity documents exposes Americans to potential identity theft and other financial harm,” said the special agent from ICE Homeland Security Investigations who led the probe.</p>
<p>Leftist groups went ballistic, asserting that illegal immigrants were victims whose “rights” were violated by the federal government. Outraged, the SPLC called it the largest workplace immigration raid since the George W. Bush administration. “What happened on April 5, 2018 was law enforcement overreach, plain and simple,” said the group’s senior supervising attorney Meredith Stewart. “We, as a nation, have a shared set of ideals, rooted in the Bill of Rights: We have a right to be free of racial profiling and unlawful arrests. If we are not willing to uphold those ideals for everyone in this country, then we are all at risk of losing our rights.” In the complaint, SPLC attorneys write that the federal officers conspired to plan and execute the forceful and prolonged seizure of the meatpacking plant’s Latino workforce solely on the basis of their actual or apparent race or ethnicity.</p>
<p>The defendants are nine ICE agents who are accused of using “brutal and excessive force without any provocation.” They cursed, shoved and punched workers, according to the SPLC complaint. A Tennessee group that’s helping in the case says the lawsuit addresses the brutality the workers faced at the hands of agents. The nonprofit, Tennessee Immigrant and Refugee Rights Coalition (TIRRC), claims the workplace raid was an “unconscionable abuse of power” with “human costs.” The SPLC, an Obama-tied leftist group that helped a gunman commit an act of terrorism against a conservative organization, has the lead in the case. A few years ago a gunman received a 25-year prison sentence for carrying out the politically-motivated shooting of the Family Research Council (FRC) headquarters after admitting that he learned about the FRC from the SPLC “hate map.” Prosecutors called it an act of terrorism and recommended a 45-year sentence.</p>

<p>Federal agents have tangled with the protesters on a few occasions, usually to break up formed lines intended to prevent agents and vehicles from coming and going, which has resulted in arrests and injuries.</p>
<p>But now it appears that ICE has adopted a different tactic to annoy and potentially even disperse the camped protesters — blasting them with tortuous music for hours on end in a bid to drive them mad.</p>

<p>Local alternative media outlet Willamette Week noted that ICE seemingly borrowed a page from the incredibly popular zombie apocalypse TV series “The Walking Dead” and adopted a tactic that had been used by a bad guy character named Negan, head of a group named the “Saviors” that was in conflict with the central group of survivors the series is focused on.</p>
<p>In one episode during the last season, Negan captured and imprisoned the popular character Daryl and forced him to listen repeatedly to a sickeningly over-the-top happy song titled “Easy Street” — by the Collapsible Hearts Club — in a bid to break his will and compel his submission, according to Uproxx.</p>
<p>“It seems to play for a couple minutes and is a continuous loop. It’s been playing for 10+ hours now,” a spokesperson for the Occupy group told Willamette Week via email.</p>
<p>The annoyingly happy music on repeat, in conjunction with triple-digit temperatures, most likely had a deleterious effect on the minds of the encamped protesters, which was pretty much the intent.</p>
<p><br/> In addition, the ICE facility has trained massive generator-powered floodlights on the protesters’ encampment to keep it bathed in bright light all through the night, no doubt preventing some protesters from getting decent, if any at all, sleep in the evenings.</p>
<p>Previously, the federal agents who reside in the ICE facility had similarly blasted Metallica’s “Enter Sandman” at the protesters, though the young protesters had dismissed that effort and song as little more than “threatening dad rock” that had little effect on them.</p>
<p>As odd as the tactic may seem to some, the repeated playing of a particular song has for some time been deemed a “publicly palatable” form of torture — or enhanced interrogation techniques, if you will — that has been used to great effect against confirmed and suspected terrorists detained for questioning, according to a 2014 article by Mic.</p>
<p>Indeed, popular songs played repetitively as a form of torture include Queen’s “We Are The Champions,” Eminem’s “The Real Slim Shady,” David Gray’s “Babylon,” the Bee Gee’s “Saturday Night Fever,” Marilyn Manson’s “The Beautiful People,” and a host of other songs ranging from peppy pop music to aggressive heavy metal.</p>
<p>Some of the more hilarious musical selections used to torture terrorists included the “Meow Mix” song from the cat food commercial and the kid-friendly “I Love You” theme song from the “Barney and Friends” TV show.</p>
<p>A spokesperson for ICE declined to respond with a comment to Willamette Week’s inquiry, and it remains unclear at this time if ICE will continue to use music as a weapon against the protesters and how effective that tactic will ultimately prove to be over time.</p>

<p><span style="color: #ff0000;"><b>1950</b>:</span> Korean War begins; North Korea and China accuse U.S. of germ warfare--charges still not proven. San Francisco disease outbreak matching Army bacteria used on city.</p>
<p><span style="color: #ff0000;"><b>1951</b>:</span> African-Americans exposed to potentially fatal stimulant in Virginia test of race-specific fungal weapons.</p>
<p><span style="color: #ff0000;"><b>1952</b>:</span> German chemical weapons researcher Walter Schreiber, working in Texas, exposed as a perpetrator of concentration camp experiments, and flees to Argentina.</p>
<p><span style="color: #ff0000;"><b>1956</b>:</span> Army manual explicitly states that bio-chemical warfare is not banned. Rep. Gerald Ford wins policy change to give U.S. military "first strike" authority on chemical arms.</p>
<p><span style="color: #ff0000;"><b>1959</b>:</span> House resolution against first use of bio-chemical weapons is defeated.</p>
<p><span style="color: #ff0000;"><b>1961</b>:</span> Kennedy Administration begins hike of chemical weapons spending from $75 million to more than $330 million.</p>
<p><span style="color: #ff0000;"><b>1962</b>:</span> Chemical weapons loaded on U.S. planes during Cuban missile crisis.</p>
<p><span style="color: #ff0000;"><b>1966</b>:</span> Army germ warfare experiment in New York subway system.</p>
<p><span style="color: #ff0000;"><b>1968</b>:</span> Pentagon asks for the chance to use some its arsenal against civil rights and anti-war protesters to demonstrate the "efficacy" of the chemicals. "By using gas in civil situations, we accomplish two purposes: controlling crowds and also educating people on gas," said Maj. Gen. J.B. Medaris. "Now, everybody is being called savage if he just talks about it. But nerve gas is the only way I know of to sort out the guys in white hats from the ones in the black hats without killing any of them."</p>
<p><span style="color: #ff0000;"><b>1969</b>:</span> Utah chemical weapons accident kills thousands of sheep; President Nixon declares U.S. moratorium on chemical weapons production and biological weapons possession. U.N. General Assembly bans use of herbicides (plant killers) and tear gasses in warfare; U.S. one of three opposing votes. U.S. has caused tear gas fatalities in Vietnamese guerrilla tunnels.</p>
<p><span style="color: #ff0000;"><b>1970</b>:</span> Sarin nerve gas used by U.S. forces in a secret raid into Laos called Operation Tailwind. "Upwards of 100'' people perished in the raid, including Laotian civilians. Platoon leader Lt. Robert Van Buskirk estimated up to 20 U.S. military defectors were killed. Adm. Thomas Moorer, former chairman of the Joint Chiefs of Staff, confirmed the raid on CNN in 1998.</p>
<p><span style="color: #ff0000;"><b>1971</b>:</span> U.S. ends direct use of herbicides such as Agent Orange; had spread over Indochinese forests, and destroyed at least six percent of South Vietnamese cropland, enough to feed 600,000 people for a year. U.S. intelligence source gives swine-flu virus to anti-Castro Cuban paramilitary group, which lands it on Cuba's southern coast (according to 1977 newspaper reports).</p>
<p><span style="color: #ff0000;"><b>1972</b>:</span> Biological and Toxic Weapons Convention. Cuba accuses CIA of instilling swine fever virus that leads to death of 500,000 hogs.</p>
<p><span style="color: #ff0000;"><b>1974</b>:</span> U.S. finally ratifies 1928 <a href="http://www.yale.edu/lawweb/avalon/lawofwar/geneva01.htm"><b>Geneva Protocol</b></a>.</p>
<p><span style="color: #ff0000;"><b>1975</b>:</span> Indonesia annexes East Timor; planes spread herbicides on croplands.</p>
<p><span style="color: #ff0000;"><b>1979</b>:</span> <i>Washington Post</i> reports on U.S. program against Cuban agriculture since 1962, including CIA biological warfare component.</p>
<p><span style="color: #ff0000;"><b>1980</b>:</span> U.S. intelligence officials allege Soviet chemical use in Afghanistan, while admitting "no confirmation." Congress approves nerve gas facility in Pine Bluff, Arkansas. Iraq begins eight-year war with U.S. arch-enemy Iran.</p>
<p><span style="color: #ff0000;"><b>1981</b>:</span> U.S. accuses Vietnam and allies of using Mycotoxins (fungal poisons) in Laos and Cambodia. Some refugees report casualties; one analysis reveals "yellow rain" as bee feces. Israel bombs Iraqi nuclear reactor, leading to Iraqi decision to build chemical weapons.</p>
<p><span style="color: #ff0000;"><b>1984</b>:</span> U.N. confirms Iraq using mustard and nerve gasses against Iranian "human wave" attacks in border war; State Department issues mild condemnation, yet restores diplomatic relations with Iraq, and opposes U.N. action against Iraq. Bhopal fertilizer plant accident in India kills 2000; shows risks of chemical plants being damaged in warfare. President Reagan orders over a half million M55 rockets retooled so that they contain high-yield explosives as well as VX gas. (The Army now claims that many of these rockets are "unstable" and leaking nerve agents.)</p>
<p><span style="color: #ff0000;"><b>1985</b>:</span> U.S. resumes open-air testing of biological agents. U.S. firms begin supplying Iraq with numerous biological agents for a four-year period (according to a 1994 Senate report).</p>
<p><span style="color: #ff0000;"><b>1986</b>:</span> U.S. resumes open-air testing of biological agents.</p>
<p><span style="color: #ff0000;"><b>1987</b>:</span> Senate ties in three votes on resuming production of chemical weapons; Vice President Bush breaks all three ties in favor of resumption.</p>
<p><span style="color: #ff0000;"><b>1988</b>:</span> Iraq uses chemical weapons against Kurdish minority in Halabjah; U.S. continues to maintain agricultural credits with Iraq; President Reagan blocks congressional sanctions against Iraq.</p>
<p><span style="color: #ff0000;"><b>1989</b>:</span> Paris conference of 149 nations condemns chemical weapons, urges quick ban to emerge from Geneva treaty negotiations; U.S. revealed to plan poison gas production even after treaty signed.</p>
<p><span style="color: #ff0000;"><b>1990</b>:</span> U.S., Soviets pledge to reduce chemical weapons stockpiles to 20 percent of current U.S. supply by 2002, and to eliminate poison gas weapons when all nations have signed future Geneva treaty. Israel admits possession of chemical weapons; Iraq threatens to use chemical weapons on Israel if it is attacked.</p>
<p><span style="color: #ff0000;"><b>1991</b>:</span> U.S. and Coalition forces bomb at least 28 alleged bio- chemical production or storage sites in Iraq during Gulf War, including fertilizer and other civilian plants. CNN reports "green flames" from one chemical plant, and the deaths of 50 Iraqi troops from anthrax after air strike on another site. <i>New York Times</i> quotes Soviet chemical weapons commander that air strikes on Iraqi chemical weapons would have "little effect beyond neighboring villages," but that strikes on biological weapons could spread disease "to adjoining countries." Czechoslovak chemical warfare unit detects Sarin nerve gas during air war. Egyptian doctor reports outbreak of "strange disease" inside Iraq. U.S. troops use explosives to destroy Iraqi chemical weapons storage bunkers after the war.</p>
<p><span style="color: #ff0000;"><b>1992</b>:</span> Reports intensify of U.S. and Allied veterans of Gulf War developing health problems, involving a variety of symptoms, collectively called Gulf War Syndrome. U.N. sanctions intensify civilian health crisis inside Iraq, making identification of similar symptoms potentially difficult.</p>
<p><span style="color: #ff0000;"><b>1993</b>:</span> President Clinton continues intermittent bombing and missile raids against Iraqi facilities; U.N. inspectors step up program to dismantle Iraqi weapons. U.S. signs U.N. Chemical Weapons Convention, but approval later blocked in Senate.</p>
<p><span style="color: #ff0000;"><b>1995</b>:</span> Japanese cult launches deadly Sarin nerve gas attack on Tokyo subway system.</p>
<p><span style="color: #ff0000;"><b>1996</b>:</span> Congressional hearings on Gulf War Syndrome focuses on Iraqi storage bunker destruction, rather than other possible causes, and does not call for international investigation of symptoms among Iraqis.</p>
<p><span style="color: #ff0000;"><b>1997</b>:</span> Cuba accuses U.S. of spraying crops with biological agents. Iraq expels U.S. citizens in U.N. inspection teams, which are allowed to continue work without Americans, but choose to evacuate all inspectors. U.S. mobilizes for military action. Senate act finally implements Chemical Weapons Convention, with a provision that "the President may deny a request to inspect any facility" on national security grounds.</p>
<p><span style="color: #ff0000;"><b>1998</b>:</span> U.S. again mobilizes for bombing campaign against alleged Iraqi bio-chemical weapons sites, after Iraq questions role of Gulf War veteran as U.N. inspector, and restricts inspector access to presidential properties and security. </p>
