<div id="newsdetail"><p>Senator Kamala Harris made a telling statement at the Vice Presidential debates earlier this week. During the debate, she made an unsolicited commitment to <a href="https://testset.io/2020/08/26/biden-campaign-reiterates-legalization/" target="_blank" rel="noopener">decriminalize</a> marijuana : “We will decriminalize marijuana and we will expunge the records of those who have been convicted of marijuana,” she said. Well, that is a great start for a former prosecutor but far too little too late. Simply said, decriminalization will still include police intervention for those carrying or smoking cannabis. Under decriminalization, public possession could be a ticket which leads users potentially getting caught up in the court system. Limiting the amount of interactions with police is key to addressing police brutality and lethal force. Recent FBI data has made it clear, law enforcement spends more time than just about anything on the policing of a relatively harmless plant: cannabis.</p>
<p>The FBI has recently released their <a href="https://ucr.fbi.gov/crime-in-the-u.s/2019/crime-in-the-u.s.-2019/topic-pages/persons-arrested?link_id=2&can_id=3f3a9cc185b030103f9f071b48ef8a9a&source=email-fbi-marijuana-arrests-outpace-arrests-for-all-violent-crimes&email_referrer=email_943424&email_subject=fbi-marijuana-arrests-outpace-arrests-for-all-violent-crimes" target="_blank" rel="noopener">Uniform Crime Report</a> and revealed more people were arrested for cannabis last year than for all violent crimes put together. </p>
<p>The data shows that law enforcement arrested 545,602 people for ‘cannabis related crimes in 2019.’ For perspective, the arrest rate for cannabis is 9% higher than the 495,871 arrested for engaging in violent crimes. To be clear, these are by and large not dealers being arrested but everyday consumers of the plant. The overwhelming majority of those arrested, a whopping 92%, were arrested for possession. Even if you backed out the 40k-ish people arrested for trafficking, the half a million cannabis possession arrests still exceed violent crime arrests.</p>
<p>There is some good news though. Arrests for cannabis dropped by 18% in 2019 versus the previous year. This is widely attributed to <a href="https://www.texastribune.org/2019/07/03/texas-marijuana-hemp-testing-prosecution/" target="_blank" rel="noopener">legal changes in Texas</a>. The state has gone through a bevvy of legal proceedings regarding its legalization of hemp for industrial use and commercial use provided the plant matter contains less than 0.3% of THC, the now-legal limit to distinguish between hemp and marijuana.</p>
<p>Nonetheless, any loosening of cannabis laws has not yet reached communities of color in states where the plant remains illegal. A 2018 <a href="https://www.aclu.org/news/criminal-law-reform/a-tale-of-two-countries-racially-targeted-arrests-in-the-era-of-marijuana-reform/" target="_blank" rel="noopener">report from the ACLU</a> found that Black people were 3.6 times more likely to be arrested for cannabis possession than White people. This contrast is stark particularly when considering that both groups use cannabis at roughly the same rates. Some states, such as Montana and Kentucky, demonstrated even worse racial disparity than others. Black people are 9.6% more likely to be arrested for cannabis. </p>
<p>As of date, 33 states permit some variant of legal and/or medical cannabis use and 11 have legalized adult recreational use. <a href="https://www.pewresearch.org/fact-tank/2019/11/14/americans-support-marijuana-legalization/" target="_blank" rel="noopener">Two thirds of Americans</a>now support national legalization. Despite this, <a href="https://testset.io/2020/06/21/a-change-in-federal-marijuana-policy-could-clinch-the-presidential-election-for-either-party/" target="_blank" rel="noopener">neither major party</a> candidate for President of the United States supports full legalization.</p>

<p>According to the FBI’s annual Uniform Crime Report, out of 1,632,921 arrests for “<a href="https://ucr.fbi.gov/crime-in-the-u.s/2017/crime-in-the-u.s.-2017/topic-pages/tables/table-29" target="_blank" rel="noopener">drug abuse violations</a>,” 36.7% were for <a href="https://ucr.fbi.gov/crime-in-the-u.s/2017/crime-in-the-u.s.-2017/topic-pages/persons-arrested" target="_blank" rel="noopener">possession</a> of cannabis. That amounts to 599,282 people, which is up from the previous year’s figure of 587,516. In contrast, as <em>Forbes</em> <a href="https://www.forbes.com/sites/tomangell/2018/09/24/marijuana-arrests-are-increasing-despite-legalization-new-fbi-data-shows/#4e918c0e4c4b" target="_blank" rel="noopener">noted</a>, arrests for the sale and manufacture of the plant dropped from 65,734 in 2016 to 60,418 in 2017.</p>
<p>Considering the drop in arrests for the sale and manufacture of cannabis, it is apparent that the increase in arrests for weed is due to possession offenses. In total, just under 91 percent of cannabis arrests were for possession. Despite a ten-year decrease in arrests prior to 2016, the last two years’ crime data show enforcement is now on the rise.</p>
<p><em>Forbes</em> calculated that according to the figures, a cannabis bust occurred every 48 seconds in the United States last year.</p>

<p>Meanwhile, arrests for violent crime in 2017 reached 518,617, a figure 21 percent lower than total cannabis arrests. Though numerous states have legalized cannabis, the federal government continues to classify it as a dangerous drug.</p>
<p><em>“Actions by law enforcement run counter to both public support and basic morality,”</em> <a href="https://blog.norml.org/2018/09/24/fbi-marijuana-arrests-spike-for-second-straight-year-far-outpace-arrests-for-all-violent-crimes/" target="_blank" rel="noopener">said</a> Justin Strekal, the political director for NORML, a cannabis advocacy organization. <em>“In a day and age where twenty percent of the population lives in states which have legalized and nearly every state has some legal protections for medical cannabis or its extract, the time for lawmakers to end this senseless and cruel prohibition that ruins lives.”</em></p>
<p>Though those arrested for cannabis possession are not always cycled through the prison system, the fact that they are processed through the courts at all highlights a monumental waste of resources spent to penalize victimless crimes.</p>

<div class="heateorSssClear"><p>Clare County, Mich. – Delores Saltzman, an 80-year-old grandma was recently arrested because she had an expired medical marijuana card and police found a very small amount of cannabis in her home, about the equivalent of just a few joints.</p>
<p>Last month, Clare County Sheriff’s Deputy Ashley Gruno went by Saltzman home and knocked on the door around 9 pm, in search of the woman’s great-granddaughter, reportedly to return a lost phone and ID. The officer immediately smelled marijuana and began interrogating the poor old woman. Saltzman was honest with the officer and told her that she was a medical patient that allowed her card to expire, and she was arrested on that small technicality.</p>
<p>She was then handcuffed and thrown in a cold jail cell where her arthritis — without the cannabis to help her — began taking its toll.</p>
<p><em>“That’s ridiculous what they do to people, they don’t need to make you that cold,</em>” Saltzman told<span> </span><a href="https://fox17online.com/2018/08/03/80-year-old-medical-marijuana-patient-with-expired-card-jailed-for-less-than-eighth-of-cannabis/" rel="noopener">FOX 17</a>.<em> “Old Arthur was screaming at me!”</em><span> </span>she said, referring to her arthritis.</p>
<p><em>“That’s what I want people to do: don’t be ashamed of something that’s going to help you feel better,</em>” she added.</p>
<p><em>“I just thought it was absolutely ridiculous to put her through this like that: they could have given her a ticket. And just show us your card later. Reapply for your LARA card, show us this, and then drop the charges,</em>” her son Mark Saltzman said.</p>
<p>Saltzman said that cannabis has saved her life, and helped her with a variety of issues, including appetite, pain, and arthritis.</p>
<p><em>“[Cannabis] saved my life because I had a bad bleed about four years ago, and Mark took care of me. After I smoke I go down to a one, pain-wise. Before I smoke, I would say I’m an 8 right now,</em>” the 80-year-old grandma explained.</p>
<p>Clare County Prosecutor Michelle Ambrozaitis made the following statement to FOX 17:</p>

<p><em>“Law enforcement went to Ms. Saltzman’s home looking for an individual who had been known to stay at that residence. When the deputy arrived, she could smell the odor of marijuana. When she interacted with Ms. Saltzman at the door, Ms. Saltzman admitted to have been smoking marijuana and possessing marijuana and that she had allowed her medical marijuana card to lapse. At that time, Ms. Saltzman turned over to the deputy 7 marijuana pipes, 4 joints, a grinder, and a purple glass jar that also held a quantity of marijuana inside. The deputy arrested Ms. Saltzman for the illegal possession of marijuana and lodged her in the Clare County Jail. Based upon that arrest, a police report and request for charges was generated by the deputy and presented to our office. My assistant prosecutor authorized a possession of marijuana charge based upon the admission by Ms. Saltzman that she wasn’t a medical marijuana card holder and the evidence that she did possess marijuana illegally. However, our goal is to ensure that individuals who utilize medical marijuana are doing so legally. As such, Ms. Saltzman was encouraged to obtain her medical marijuana card and if she did so, the case would be dismissed. She did obtain her medical marijuana card and the case was dismissed.”</em></p>
<p>Luckily, this week, a Clare County judge signed an order to dismiss Saltzman’s case, however, she still had to spend a night in jail, which was likely traumatic and could lead to health problems for people with compromised immune systems, which is common at her age.</p>
<p>Showing the callous, cruel, and inhumane nature of the drug warriors, the sheriff had no remorse and was proud to have thrown a grandma in jail.</p>
<p><em>“What the person was doing was illegal, had she renewed her medical marijuana card she would have been fine. I agree with the action the prosecutors office and allowing the subject to renew her card, thus dismissing the case. The person was illegally in possession of marijuana,”</em><span> </span>Clare County Sheriff John Wilson said.</p>

For those who thought reefer madness was a thing of the past, a lawmaker in New Jersey will quickly reverse that thought.</div>

<div id="newsdetail"><p>State Sen. Ronald Rice (D) —a lawmaker who calls himself a “progressive” — recently told reporters that he believes marijuana is a gateway drug that if legalized will lead to the selling of “sex toys and oils” all over the state. Rice, completely contradicting the massive evidence to the contrary, claims that if New Jersey legalized cannabis, “the number of people who’ve never used any type of drugs goes up substantially in terms of drug use.”</p>
<p>However, as TFTP has reported, Rice is dead wrong. Even t<a href="https://thefreethoughtproject.com/wa-state-weed-legal-teen-use/">he government’s own studies</a> show that legalizing weed actually reduces teen drug use, opioid addiction, as well as prescription drug use.</p>
<p>As TFTP reported last year, the <a href="https://www.wsipp.wa.gov/ReportFile/1670/Wsipp_I-502-Evaluation-and-Benefit-Cost-Analysis-Second-Required-Report_Report.pdf" target="_blank" rel="noopener">Washington State Institute for Public Policy </a>commissioned the study. It found that pot use among teens fell from 20 percent in 2010, to just 17 percent in 2016. The survey asked nearly 11,000 high school sophomores if they’d consumed cannabis within the last month. The results indicate not only are fewer teens using cannabis on a monthly basis, but the fears that teens would become pot addicted were unfounded.</p>
<p>What’s more, Rice’s comment about marijuana being a gateway drug is also an outlandish conspiracy theory, proven wrong time and again by science.</p>
<p>Legal weed is actually the opposite of a gateway drug as it helps people to <strong>stop using other drugs.</strong></p>
<p>In the latest of dozens of studies proving the healthful benefits of cannabis, researchers in Canada found not only can marijuana be effective in managing pain, but it can reduce a user’s dependency on tobacco, alcohol, and can replace a number of prescription medications — including antidepressants.</p>
<p>The study specifically found that marijuana isn’t the “gateway drug” politicians and detractors have claimed it is for decades.</p>
<p>Published in the <em>International Journal of Drug Policy</em>, the <a href="https://www.ijdp.org/article/S0955-3959(17)30013-0/abstract">study</a> — comprised of 271 participants enrolled in Canada’s <a href="https://www.laws-lois.justice.gc.ca/eng/regulations/SOR-2013-119/">Marihuana for Medical Purposes</a> program — is considered one of the first to evince how cannabis can help alleviate substance addiction.</p>
<p>But these facts are apparently irrelevant to the New Jersey lawmaker who thinks that legal weed will turn people into drug raged sex addicted zombies.</p>
<p>“If in fact we legalize recreational marijuana, right across the street from my office they’re going to put up stores,” Rice told <a href="https://www.njtvonline.org/news/video/marijuana-bill-amendments-do-little-to-change-mind-of-key-opponent/" target="_blank" rel="noopener">NJTV</a> last week. “They want to call them dispensaries, but they’re going to be stores that do retail selling cupcakes with marijuana, candies with marijuana, <strong>sex toys and oils with marijuana</strong>, lipsticks with marijuana, all those kinds of products that kids can get and people can get.”</p>
<p>Rice had no problem expressing his reasoning behind his fear of legal weed either — it will mess up the “white” people.</p>

<p>“I’m five blocks away from Seton Hall University in South Orange, New Jersey <strong>which is a predominant rich, upper-middle class, white community, college community.</strong> What we know is that when you legalize marijuana recreationally, the number of people who’ve never used any type of drugs goes up substantially in terms of drug use,” Rice said.</p>
<p>Again, Rice is entirely wrong and has zero evidence to back up his claims. But facts be damned, no one will sell weed to his white upper-class friends.</p>
<p>Luckily — for the sake of sanity and humanity — Rice is opposed by many in the state who are pushing to legalize weed in order to stop the senseless incarceration of otherwise innocent people and even expunge the records of those who’ve been arrested for weed in the past.</p>
<p>“Expungements have to happen. I will not support it unless there’s language in there to support expungement. There’s individuals who look like me, and those individuals who do not look like me, that are incarcerated for little, small portions of marijuana,” Assemblyman Jamel Holley said.</p>
<p>Holley is also supported by the governor, Phil Murphy who noted that “You can’t incarcerate somebody who did something on Friday, and allow someone who did the same thing on Monday to do it legally.”</p>
<p>As the marijuana debate continues, those who continue to push the reefer madness on their citizens, are quickly being exposed for the lunatic drug warriors they are.</p>

<p>Instead of attempting to fight the case on the grounds that the evidence against him was wrong, McCoy instead argued that <strong>the laws were wrong.</strong> He was honest about his experience and his medical use of cannabis during the trial, and the jury acquitted his case, despite the evidence against him.</p>
<p>McCoy’s lawyer, Catherine Bernard, said that McCoy is not the type of person who belongs behind bars.</p>
<p><em>“<strong>The jury appreciated his honesty throughout the case—including testimony at trial and statements to police—and recognized that a good, hardworking man living a quiet life and not bothering anyone didn’t deserve a felony conviction for his actions</strong>,”</em> Bernard said.</p>
<p>This is just the most recent case of a jury nullification victory for cannabis users, but this strategy is becoming increasingly popular.</p>
<p>For those who do not know, <a href="https://thefreethoughtproject.com/police-confiscate-jury-nullification-flyers-activists-judge-ordered/" target="_blank" rel="noopener">jury nullification</a> is basically the right for any juror to not only judge the facts of the case but to also actually judge the validity of the law itself. This means that if a jury feels that a defendant is facing an unjust charge, they actually have the right to rule in the defendant’s favor, even if they are technically guilty under the court’s standards.</p>
<p>Considering the fact that most of the nonviolent offenses on the books today are extremely unpopular for a variety of reasons, you would think that jury nullification would be household knowledge, or even taught in schools. However, this is a very well guarded secret, with many judges actually preventing the defense from informing juries of their right to nullify laws that they feel are unjust.</p>
<p>In fact, in 2016, New Hampshire House became the <a href="https://thefreethoughtproject.com/jury-refuses-convict-cannabis-user-lawmakers-courts-inform-jurors-nullification/" target="_blank" rel="noopener">first state</a> in the nation to consider a bill that would require courts to inform juries of their right to vote not guilty when the verdict would produce an unjust result.</p>
<p>Attorney Catherine Bernard could not be immediately reached for comment, but posts on her Facebook page suggest that the judge attempted to block her from discussing jury nullification in court.</p>
<p><em>“Today, I quoted Article 1, Section 1, Paragraph XI of the Georgia </em>Constitution<em> to the jury. The judge interrupted and told them it was ‘not a correct statement of the law.’ The judge took an oath to uphold that Constitution. What’s going on here?”</em> Bernard wrote.</p>

<p>It is sadly common for judges to prevent talk of jury nullification in their courtrooms, as cannabis activist Ed Forchion, aka “NJ Weedman,” learned during one of his <a href="https://www.activistpost.com/2012/10/nj-weedman-found-not-guilty-in-jury.html">j</a><a href="https://www.activistpost.com/2012/10/nj-weedman-found-not-guilty-in-jury.html" target="_blank" rel="noopener">ury nullification victories</a>.</p>
<p>Forchion was passionate in the closing arguments of his 2012 trial, wearing a shirt that said “<strong><em>Marijuana … It’s OK. It’s Just Illegal,</em></strong>” and telling the jury that he had been munching on edibles throughout the whole trial. Then at one point, he was nearly held in contempt of court for trying to advance his jury nullification argument.</p>
<p>In the years since Forcion has faced constant harassment from the authorities and has been arrested on numerous occasions. Luckily, he was still able to win over the jury earlier this year when he was found not guilty after spending over <a href="https://www.nj.com/marijuana/2018/05/nj_weedman_is_out_of_jail_after_400-plus_days_but.html" target="_blank" rel="noopener">400 days</a> in jail on trumped-up witness tampering charges, which were related to a prior marijuana case.</p>

However, the GHSA should genuinely call itself “<em>The Alcohol Industry’s Voice,</em>” as its latest report is entirely funded by the alcohol industry in a blatant attempt to paint cannabis users as the real highway villains.</div>

<div id="newsdetail"><p>GHSA’s <a href="https://www.ghsa.org/sites/default/files/2018-05/GHSA_DrugImpairedDriving_FINAL.pdf" target="_blank" rel="noopener">report</a> was funded completely by the Foundation for Advancing Alcohol Responsibly (www.<a href="https://www.responsibility.org/who-we-are/members/" target="_blank" rel="noopener">responsibility</a>.org) and is titled “<em>Drug-Impaired Driving: Marijuana and Opioids Raise Critical Issues for States.</em>” The report was quickly broadcast across mainstream media outlets who are also largely funded by the alcohol industry’s advertisements. Curiously absent from the <a href="https://www.usatoday.com/story/money/cars/2018/05/31/drugged-driving-marijuana-opioids/658778002/" target="_blank" rel="noopener">media coverage</a> though was the fact the report was entirely paid for by Responsibility.org.</p>

<p>GHSA’s report pins the blame for impaired driving deaths on cannabis and opioids. Listed in the report are a number of disturbing encouragements to law enforcement agencies:</p>
<ol>
<li>Advanced Roadside Impaired Driving Enforcement (ARIDE) for a “majority” of police officers</li>
<li>Implementation of “oral fluid devices” to test for drugs</li>
<li>Increasing the number of Drug Recognition Experts (DRE’s)</li>
<li>Training of judges and prosecutors to enforce Driving Under the Influence of Drugs (DUID) laws</li>
<li>Train officers to investigate drug impairment even when alcohol is suspected in DUI cases</li>
<li>Authorize electronic search warrants for drug tests</li>
<li>Penalize people when they refuse drug tests</li>
<li>Require blood testing for drugs</li>
<li>Establishment of DUID laws equivalent to DUI laws</li>
<li>Drug-testing fatally injured drivers as well as any and all surviving drivers where a fatality has occurred</li>
</ol>
<p>Nearly all of the “<em>recommendations</em>,” if implemented, will lead to increased mass incarceration of the U.S. populace, which already has the <a href="http://www.prisonstudies.org/country/united-states-america" target="_blank" rel="noopener">largest prison population</a> in the world. The recommendations could lead to more completely innocent and unimpaired drivers being jailed by, as The Free Thought Project has reported on numerous occasions, so-called Drug Recognition Experts.</p>
<p>The costs of more DUIs will only enrich lawyers, drug-testing programs, probation companies, and vehicle-installed DUI device corporations. Additionally, research indicates that<strong> THC tests of saliva and THC-blood levels are no indication of impairment and can remain in a person’s system for up to 30 days following consumption</strong>.</p>
<p>While the GHSA’s report appears to be concerned with “<em>highway safety</em>,” it relies on highly subjective and unreliable data to arrive at its conclusions and subsequent recommendations.</p>
<p>Many Emergency Room doctors or nurses can testify that it is often the drunk driver who survives an accident whereby other drivers are killed. However, such qualitative data is absent from GHSA’s data analysis, which used the National Highway Transportation Safety Administration (NHTSA) stats from 2006, 2015, and 2016 to arrive at its conclusion that more drivers who die in accidents were on drugs than alcohol. GHSA reported:</p>
<blockquote><p>In 2016, 43.6% of the drivers with known drug test results were drug-positive. In 2015, of the drivers with known test results, 43.0% in the annual report le and 43.4% in the nal le were drug-positive.</p>
<p>Of the drivers with known alcohol test results, 37.9% were alcohol-positive (any alcohol at all) in 2016 compared to 38.0% in the 2015 annual report le and 38.1% in the nal le.</p>

<p>Wow! Isn’t that a convenient statistic? The alcohol industry paid for a report that appears to show drugged drivers were more likely to die in accidents than alcohol-impaired drivers. All of which should come as no surprise to those who funded the report. Fortunately, as TFTP has <a href="https://thefreethoughtproject.com/five-marijuana-myths-debunked/" target="_blank" rel="noopener">reported</a>, these myths have already been debunked by researchers who are not being paid by Big Alcohol:</p>
<blockquote><p>Citing the National Highway Traffic Safety Association, Forbes reported that not only is marijuana use safer than alcohol use when it comes to driving, but far fewer fatalities are recorded when marijuana is present than when alcohol is present in traffic fatality instances. “It looks like marijuana’s impact on traffic safety has been greatly exaggerated,” writes Forbes.</p>
</blockquote>
<p>Research from the American Automobile Association (AAA) has also shown that <a href="https://thefreethoughtproject.com/bombshell-aaa-safety-foundation-finds-scientific-basis-thc-blood-impairs-driving/" target="_blank" rel="noopener">no scientific basis</a> exists to legitimize current THC testing because a blood test threshold for THC—the chemical component of cannabis that makes people ‘high’—is not scientifically possible:</p>
<blockquote><p>Those tests employ a blood level-based judgment similar to that used for determining alcohol impairment. But AAA found such tests for THC are wholly unreliable—sending potentially unimpaired drivers to jail and putting impaired drivers back behind the wheel.</p>
<p>There is understandably a strong desire by both lawmakers and the public to create legal limits for marijuana impairment in the same manner we do alcohol,” said AAA president and CEO, Marshall Doney, as reported by the Associated Press. “In the case of marijuana this approach is flawed and not supported by scientific research.”</p>
</blockquote>
<p>Not only does it appear that the GHSA’s statistics are flawed, but it is also clear that they do not align with other non-biased organizations’ conclusions. However, one of the most disturbing issues that have been revealed by this report is the fact that the alcohol industry is training law enforcement officers, prosecutors, and lawyers on how to detect, charge, litigate, and prosecute cannabis users in the judicial system.</p>
