Was Joshua Brown's Evidence Against Guyger Too Damning?

Playing Devil’s Advocate, I am looking at the murder of 26 year old Botham Jean as being something more like a "neighbour dispute" gone-wrong, than that of a police officer supposedly so exhausted from work that she mistook her apartment for the one under her own, forced her way in, - and immediately fired off her service weapon into the body of an innocent man.

It was not clear whether the door was locked, as why would it have been open? It's been said it was a "faulty lock", and why Guyger thought she had been broke into and entered the apartment. 

Yet according to Joshua Brown's evidence, he too had admitted getting out of the elevator onto the wrong floor before, in fact Guyger's same floor, though he instantly realised he had made a mistake as on Guyger's floor there is a table with flowers. 

Surely the same should have happened to Guyger, as she too would have noticed there was no table with flowers on the floor she was now standing, - and would have realised she was on the wrong floor.

Brown had said that on his way home from watching a football game on the day Jean was killed, he heard "an exchange" between two people who both seemed “surprised” while in the hallway of his building.  “Right after” the exchange, he said, he heard two quick gun shots.

Brown's Evidence Contradicts Guyger's 

Guyger said that she heard Jean "before entering his apartment" - and gave commands for him to show her his hands as she entered", but she said that he moved towards her.

Though Brown's testament contradicts Gurger's claim that she "gave commands for him to show her his hands as she entered", for when asked by prosecutors if he could make out what words Guyger and Jean exchanged, Brown said no. When questioned, he said he did not hear any police commands from Guyger such as “put your hands up.”

Looking through the spy-hole of his own apartment door, Brown said, he could see Guyger crying and walking back and forth in the hallway. She was on the phone, explaining she had entered the wrong apartment. Brown also testified that he saw Guyger re-enter Jean’s apartment.

The prosecution was trying to establish how close Brown's apartment was from Jean's, and Brown made arm gestures showing how close their front doors were opposite to each other's, and that he could spread out his arms and touch both doors. He said, "...when I come out, and lock my door, I can hear him."  The prosecution replied, "So from the hallway you can hear his (Jean) activities from inside his apartment".  Brown replied "Yes mam". 

This confirms these kind of apartments, and like millions of others worldwide, they are badly soundproofed.  It's something the world’s home builders really need to sort out, and it's all down to money as to why so little is spent on soundproofing homes, and why it's so noisy to live in some places. 

When you're a key witness such as Brown, you are not allowed to hear any other evidence, and just have to await your turn to be called to give your testimony.  It's not until after the trial and verdict, that witnesses then have the opportunity to hear and read what else was said at the trial.  Often enough you can hear of evidence and witness statements that in a sense could not be correct, or even true, - and that this "additional evidence" was likely fabricated instead of being factual.

Let's say there was to be an appeal against Guyger's sentence; defending Guyger's actions that '...was she to have genuinely thought she was in her own apartment then she had every legal right to defend herself' - and that her 'mistake' was exactly that, a tragic mistake thinking at the time she had every right to "defend" herself.  I'm not saying this will happen, as after all Guyger's sentence was extremely light, for in five years time she could be released.

But let's say there was to be a retrial, or a further investigation was to take place, - or that Brown was to say that the complaints he and Jean had received was connected to why he heard "an exchange" between Guyger and Jean.  As this would indicate there was another reason as to why Guyger was on Jean's floor and inside his apartment.  After a long evening at work and perhaps coming home and being greeted with a TV, or music blaring out from Jean's apartment above hers, it would perhaps warrant Guyger making a "courtesy call" to her neighbour, asking Jean could he kindly turn the volume down as she wishes to go to sleep.

Who knows how Jean would have reacted to such a request, and how courteous was Guyger in getting her "complaint" across to him, if of course this is what happened, though I could be right, as one piece of vital evidence, which seems to have been overlooked, is that Brown also said, "...he and Jean met for the first time the day Jean was murdered, - and when "they" received a "noise complaint."

This mentioning of a "noise complaint" is very important. I cover it a little further below; as there must be a supporting evidence-trail as to who made the noise complaint? Like most noise complaints especially when two residents get the same kind of complaint notice at the same time, - it comes in the form of a letter.  It can also be a direct visit, and/or a "verbal warning" from the landlord, police or town hall officials etc.  Were these complaints sent directly from the Landlord, or Building Management Service? Was it the local town hall authorities or police department? Or was it a "personal complaint", perhaps a hand written, or typed note from the person doing the complaining, and posted to those they are complaining about?   

If this was reinvestigated it would probably reveal who the complainant was; which leads me to conclude it could quite possibly be that Guyger had lodged complaints of excessive noise coming from the floor above her, and where both Jean, and Brown lived.  If this is the case, then of course this evidence could be detrimental to Guyger's evidence as it would prove there was a previous connection and complaint made about the noise levels coming from both Brown and Jean's apartments.

Yet another Tweet by Amber Guyger which tends to suggest she's ready to "take you out" whenever she feels like it.

Guyger's defence team claimed that she mistook Jean's apartment for her own, which was one floor below, and that as she entered the apartment of 26-year-old Botham Jean, fatally shot him as he watched TV on the couch, - though according to Brown's evidence this was likely not to have been the case, as Jean was one minute having an "exchange" with Guyger, then soon after Brown heard two shots fired.  This means it would have been very unlikely for Jean to have just gone and sat down on his sofa with a neighbour pointing a gun at him, - and more likely something was said by Jean, or an action taken, - that provoked Guyger to shoot him.

Prosecutors argued that; “When you listen critically to what she (Guyger) is saying, you are going to hear that she is as concerned, or more concerned about how this is going to affect her than this poor guy on the floor next to her," - and referencing a 911 call Guyger made shortly before 10 p.m., in which she said 19 times that "she was in the wrong apartment."  While she was on the phone with a 911 dispatcher, Guyger sent two text messages to her partner on the same police force - whom prosecutors said she was in an intimate relationship with, at 10:02 p.m. saying, "I need you ... hurry,", and another a minute later saying, "I f***ed up".

Authorities recovered those text messages, but Guyger allegedly deleted other messages; though Smartphone forensics experts could retrieve just about anything from any phone. Jean’s family lawyer, Lee Merritt, seen above, said on Twitter Monday Rivera and Guyger exchanged text messages before, during and after Jean’s death and that some of those messages included nude photos.

“Those text were subsequently deleted,” Merritt said. “This is a crime. Destruction of evidence is a felony. Martin Rivera should not be a police officer.”

The attorney also said on Twitter Tuesday that the bodycam footage depicting Jean’s last moments “not only establish a peaceful scene of a man at home watching TV, eating ice cream but also where his body lands— directly next to his couch.”

Merritt refuted what he described as the defense’s claim that Jean charged at Guyger.

So why have the "police" been not able to retrieve Guyger's alleged text messages, - or did they? - I suspect the latter, - and if so was it incriminating? 

Let's not forget it's the police investigating the police, even Guyger's boyfriend works for the same police force. 

To what levels would you go to, to cover-up what may have really happened and in order to save your fellow colleague from losing their job, and face prosecution for murder?

There's always the possibility this was premeditated murder in the sense that had Guyger gone upstairs to Jeans apartment to "complain" about his noise, - and that if he was unwilling to "cooperate" with her, - then she'd "let him have it", and say what she has said happened, which is go to the wrong apartment by mistake. 

Most of us have experienced inconsiderate noisy neighbours, and why perhaps it's one of the biggest reasons as to why "neighbour’s" fall-out with each other. 

It's bad enough if you live next-door to someone and share the same inner walls as in the case of most terraced houses, however, when it comes to living in "apartments" you can at times be surrounded by fellow tenants.  This can mean from underneath, either side, and from above you can hear each and every neighbour as they go about their everyday living.

With super-sized TV's with built in surround-sound systems, when the volume is too high for those having to share the same inner walls, floor or ceiling, it can sound as is the TV, or sound-system is in the very same room you're in, and not coming from elsewhere.  When sports are on, football, basketball etc. some folk sure can get over excited and their noise levels can rise to more than what is accepted to be a "considerate volume".   The same can be when listening to music, as quite often enough the base-line is deep and heavy and can often make the walls, floors, or ceilings shake. 

When living in these kind of "shared-party wall apartments" there's no escape from the noise. It is and can be a nightmare for those surrounded by an inconsiderate neighbour, who often enough knows exactly what they're are doing, - as they too experience and hear all the noise that surrounds them. 

Neighbors Killed for Making Noise

Many "tenants" and neighbours have lived side by side to each other with hardly a word exchanged between them. Quite often you can find yourself "victim" to anti-social behaviour; such as you're car tyre/s could be deflated or slashed, the bodywork scratched, aerial broken etc. - rubbish left outside your door, your locks are glued, bike stolen, broken or sabotaged in general, clothes getting stolen from washing lines etc., to the more sinister end of poisoning someone's pet dog, cat, fish, birds etc. And when someone finally cracks and cannot take anymore, fights and arguments can arise resulting in serious injuries, - or murder.

All these incidents could have come about for whatever reason; over a car parking space, TV/music being played too loud, not saying "hello", for giving someone a hard-look, pet's pissing, or shitting on your doorstep etc., washing-line space, or whose next using the laundry room are just a number of incidences that can come-about when living in apartment blocks. 

I've experienced it and would be lying to say that at times I wanted to "kill" certain neighbour's due to their excessive noise.  I used to work shifts, some nights and days, so there was no escape from the TV's and music systems playing all around me.  At times it was impossible to sleep as it was as if the TV or music was in the very same flat I lived in, yet wasn't the case.  So I had many a heated argument with these kinds of inconsiderate neighbours, and why often I moved elsewhere. This was because no matter how many times you complain, that instead of the situation improving, it often enough gets worse as "they" know what triggers you, so often enough will do it to piss-off those around them.

Also in Dallas, Texas - in 2012 - This is a good example as to how things can soon escalate when complaining about noisy neighbours, and how something like this could have happened between Guyger and Jean when  'a former firefighter shot dead his neighbour and wounded two others over loud music they were playing at a birthday party. He claimed he acted in self defense - and that his home video proves it.

Raul Rodriguez, was charged with the murder of elementary school teacher Kelly Danaher, presented the 22-minute video as evidence in his trial, in Houston, Texas. In the video, Rodriguez can be heard on the phone to police as he begins walking towards the house, with a gun and flashlight in his hand - perhaps a sign he expected the situation to escalate..."

The jury convicted Raul Rodriguez of murder and sentenced him to life in prison, rejecting his claim that he shot his neighbor, Kelly Danaher, in self-defense.

I never thought Jean's murder was anything other than to do with a noisy neighbour complaint and why when I first read Botham Jean had been fatally shot in his apartment by a tenant who lived directly underneath him; I didn't think about whether they were black or white, male or female, or what professions they may have worked in, other than I thought I bet this incident which started off with "complaints about noise", and it so happened to turn out that both Jean and Brown was issued one, - that this was the reason the tenant with the gun shot the tenant who lived above them. 

I say this, as some years ago I had worked for over 12hrs, and hadn't slept for over 24hrs, so really needed my sleep. I was noisily and abruptly awoken by the noise of pneumatic drills.  It was a Sunday, so I looked outside to see what was going on as I didn't expect any work to being going on that day.  It was three men digging up the roads and pavements so as they could lay cable TV. I at first politely asked them to stop drilling and that they shouldn't be doing it on a Sunday.  One thing led to another and I ended up having a fight with two of the workmen.  One smashed me over the head with a metal kettle.  I was so incensed by their inconsiderateness, I picked up and threw all their tools across the road and disconnected their cables.  Had this happened in the USA, and not the UK where it did, and we perhaps all had guns to carry, it would have probably ended in a bloodbath, as I was willing to kill those noisy, arrogant and rude workers that day. 

I've personally had at least 5 to 6 encounters with "noisy" neighbours from hell, and often resulted in an argument and when you never again talking to each other, despite living side by side. 

Of course there is never a justified reason for using violence, and most disputes should be able to be resolved if those involved are "reasonable people" and can understand that there is a certain way we should all live and respect each other’s space, - which includes the kind of noise levels we can all create. 

So what I'm trying to say, is that I can see where Guyger may have been coming from, were she indeed 'welcomed' back home to a really noisy apartment when all she wanted was to wind-down, relax and then sleep ready for her next shift. 

And if this was the case, then the truth has been covered up by the police and why Guyger was able to change her version of events and say what she had.  At the time she was probably unaware what Brown had seen and heard, and thought she could get away with it. 

It means Guyger was more likely living up to one of her memes on Tweeter, - and probably regrets losing her cool that night as opposed to her sorting out the matter in a more professional way.

So was it premeditated murder, - or a random event like what we've been led to believe?

Exposure - Since then, I've had to have a battle of the bands with a couple neighbors. These are the songs that won out for my side - Big Black - Cables and She's a Pass - Dredd soundtrack . Put those on repeat for an hour, and they'll give up.They carry through walls and ceilings. Wurm - Should We Be Proud would also definitely be a contender for this purpose.

Exposure - Thanks, but of course it's always preferable to avoid those situations, if one can. I had a bad case of misophonia, "hatred of sound", a symptom of autism. Certain sounds drive me nuts, and hammering at night was apparently one of them. But, from then on, they did stop at a reasonable hour. And no one even had to be shot or stabbed, lol.

If the victim had not been black, the tweets would have been disallowed as "prejudicial", as in the case where a cop fired five rounds into the back of a man he had instructed to crawl up a motel hallway in an extremely complicated manner. The man was drunk, and made the mistake of trying to pull his pants up at some point. - Man begs for life before being killed by police

The cop used a submachine gun, and engraved on the ejection port cover were the words "YOU'RE FUCKED". The judge decided that informing the jury of this would be prejudicial. The victim was White.

When I was a factory worker, those in the apartment above me were doing remodeling work in exchange for some rent, and worked into the night, hammering and so on. So, very late at night, well after the hammering ceased, I took my Magnavox D8443 Power Player,

laid it on it's back on my bed in the manner of when the writer tortured the main character in A Clockwork Orange, and turned on a recording of Bach'ss Toccata and Fugue in D Minor at full volume, and luxuriated in my revenge.
