PENN TOWNSHIP, Pa. — A Perry County man spoke out exclusively to CBS 21 just hours after being charged with homicide in his daughter's death.

Ciara Meyer was accidentally shot by a constable who was serving her dad an eviction notice in Perry County earlier this month.

Donald Meyer left a magistrate's office in Enola feeling angry on Thursday.

"They're responsible for the murder and shooting of my daughter and me, and now it's a big cover up. They're charging me with a felony for protecting my family?" Meyer said.

He's charged with criminal homicide and involuntary manslaughter for the shooting death of 12-year-old Ciara.

Meyer never pulled the trigger, but Perry County District Attorney Andrew Bender said Ciara was put in danger by her father's behavior.

"Mr. Meyer's reckless conduct, knowing his daughter was standing behind him, triggered a chain of events that tragically lead to the death of Ciara Meyer," Bender said.

Investigators say Meyer pulled a gun on the constable, and the constable fired once. The bullet passed through Meyer's arm and hit and killed Ciara.

Investigators say the constable was justified in firing, but the constable is still so shaken up. It will be a while before he returns to work.

"It's been described to me as just completely distraught, certainly something that he didn't want to see happen," Bender said.

Authorities say Meyer was committed back in 2011 for mental health problems and never should have owned guns.

"He purchased weapons since that time, but he did so by falsifying the firearm transfer action record and wasn't providing truthful information," Benders said.

But Meyer still doesn't feel as though he's in the wrong.

"Heck no. Now they're charging me with murder of my own daughter. My God they stole everything from me. Everybody knows I love kids. My daughter wasI wouldn't have killed her," Meyer said.

Meyer also told CBS 21 he was not given the opportunity to call anyone and that he wants to call the ACLU and NRA.

Officials do not plan to file charges against Meyer's wife, who was home when the shooting happened.
