Under the current legal system, albeit broken and corrupt, the normal process, upon making the arrest or detaining a SUSPECT - the suspects still has basic legal rights, i.e. MIRANDA, and they need to be conveyed to the suspect in question.

Under United States law, an element of a crime (or element of an offense) is one of a set of facts that must all be proven to convict a defendant of a crime. Before a court finds a defendant guilty of a criminal offense, the prosecution must present evidence that, even when opposed by any evidence the defense may choose to present, is credible and sufficient to prove beyond a reasonable doubt that the defendant committed each element of the particular crime charged.

My understanding is that the bombing subject is a nationalized US Citizen. If he obtained his citizenship under false facts than his Citizenship can be cancelled and he can be treated like a foreign national terrorists with no rights. I think he did obtain his US citizenship under false facts and lies.

And it is THIS what I believe is the biggest fight on our hands right now. To make sure they can't invoke the Patriot Act and NDAA to detain this man without being indicted by way of our legal system and given a fair trial.
