A Colorado legislative committee approved a bill today that would hold gun makers liable for crimes committed with their guns. Judge Andrew Napolitano explained that the law would impose civil liability for the weapons manufacturers and sellers or reseller.
Crowds of gun supporters rallied outside the state house in Colorado yesterday as victims of gun violence testified for and against this bill. Police were among those who testified and argued that the law is unenforceable.
Judge Napolitano reasoned, “Can we hold General Motors liable because an automobile kills someone even if it’s recklessly, even if it’s used criminally? Of course not. We just don’t do that in America. This transference of liability is basically wrong and unfair.”
Regardless of whether it’s fair or not, President George W. Bush signed a federal statute that says the manufacturer and the seller can’t be held liable for the criminal use by the end user of the product. Judge Napolitano said Colorado is either ignorant of the federal law or making a political statement because if the bill reaches the governor’s desk, the federal law will be upheld.
