Lets look at it from common law perspective. ODOT is a company and as such a legal fiction. The company cannot 'own' anything because it exists only on paper. Maybe CEO may claim ownership, but I doubt he/she will have a purchase record to prove it. The land in question is a public land fraudulently claimed by ODOT.
Chris of the family Masters - The land belongs to ODOT (Oregon Dept of Transportation), so it is govt land and they want $.
Nobody objects against the permit requirement. Permission to plant roses on private land? why?
And here's what the city followed up with:
This is what happens when local people take action. ODOT doesn't clean the area of trash - the neighborhood does. Then ODOT complains the rose bushes are a distraction - apparently the trash and tents were not. Now ODOT claims the signs and ribbons are a safety issue - yet they weren't concerned about the used needles and trash. Liberal logic!
