Woman Arrested for "Terrorist Threat" for Reading Constitution In Protest of Property Taxes Doubling

NJ woman arrested, forced to turn over guns, after reading Constitution during tax dispute at public meeting - Hart was charged with making "terroristic threats" and told that if she didn't turn over her weapons, her bail would be prohibitively high

(Erica Ritz) A New Jersey mother was arrested and told to turn over her guns after reading the Constitution and peacefully protesting at a tax dispute forum, she says.

Eileen Hart was with her husband Keith and her 7-year-old daughter on Saturday at the Gloucester Community Center to dispute a mandatory home re-evaluation that would roughly double her property value (and therefore dramatically increase her rates), objecting on multiple grounds. As an Orthodox Jew, she refused to have the inspectors in her home when her husband was away at work. As an American citizen, she objected to the seemingly arbitrary reappraisal, noting that she is not planning on selling her home and hasn't renovated her kitchen in 30 years.

But at the forum, Hart was allegedly told that since she didn't let the inspectors into her home, the state has a right to "assume" its value.

"How could they assume that my value had doubled when there is absolutely no housing market?" she asked TheBlaze rhetorically over the phone. "There is basically no GDP growth."

After Hart started citing the Constitution, a representative of Appraisal Systems, Inc.-- the companycontracted by the state to conduct appraisals-- started "freaking out," she said, and called for New Jersey tax assessor Robyn Glocker-Hammond.

"Sit down and shut up," Hart said Glocker-Hammond told her, adding that she (Glocker-Hammond) was there to "enforce the law."

"I didn't see a badge," Hart noted. "Her title is tax assessor, not law enforcement officer."

Glocker-Hammond started speaking to Hart's husband like a "two-year-old," Hart claimed, and after she objected, Glocker-Hammond once again told her to be quiet.

"I have a right to speak out against this, this is a public place, my tax dollars pay your salary," Hart objected to the tax assessor, already incredulous at the drastic increase in her rates.

"I don't work for you," the assessor allegedly retorted.

At that point, Appraisal Systems, Inc. representative Andrew Colavecchio started advancing towards her, she said, like he was about to grab her arm. "Don't you dare touch me," she said after he allegedly got so close he touched her coat.

Glocker-Hammond then told her she had to leave the public forum and threatened to call the authorities, though Hart swears she never cursed or acted inappropriately.

That's when things got serious.

As Hart left the building she saw Colavecchio "sneering" at her and said to him in passing, "look at the little pencil-pusher."

Hart said Colavecchio threatened to call 911 and "ran after us in the parking lot like a banshee, his face was purple, [he was] disheveled, [he] started to take down my license plate and ran off. When he got to the doors of the building he screamed at us, 'let's see if you can pay your taxes now!'"

Much to her surprise, Hart returned home to numerous police cars, the officers asking if they could bring her in for questioning even though they did not have a warrant. She was not allowed to drive behind with her husband, but was forced to ride in the police vehicle.

Colavecchio had apparently told the police that Hart was "yelling and screaming" and threatened to return to the meeting with a gun.

Here's my point ... and then I promise to shut up about this.

No sane person goes into this type of meeting citing the Constitution ... they go in with proof that the assessment is wrong. Period. As I mentioned in a prior comment, if the assessment is wrong, that's easy enough to prove. I've, personally, appealed an assessment and got a quick decision in my favor (okay, it took 30 days for the written decision to get to me but it only took one visit to get a favorable ruling) because I walked with a cool head and hard facts. Because you are only out the time to actually make the appeal and show up for the hearing, there is no better way to win. At the time, I was living in a much larger house and those few minutes with the assessor were worth a little over $800 in lowered taxes.

Once the guy touched her she could have demanded his arrest for assault ... there almost certainly was a LEO nearby. But she didn't ... she was in ballistic mode when she walked through the door. Folks ... if your rights are being trampled, learn to fight them the right way -- the way that will win, enrich your pocket and empty the pocket of your opponent.

The issue was money. If that had been resolved she would have had no other complaints.

Eileen Hart noted "that she is not planning on selling her home and hasn't renovated her kitchen in 30 years". Neither of those are relevant to a tax assessment. Really ... how could your future plans affect the current value of your property? They can't. She said she hadn't fixed up the kitchen in 30 years. She needs to talk to her husband about that, not the assessor she refused to allow to see the interior of her home.

Knowing that she hasn't renovated the kitchen doesn't tell us much. 

Let me explain that with a definite, factual, example.

I haven't upgraded my kitchen, either. But in the past year and a half I've added a new tin roof and gutters to both my house and garage, stripped out the old wiring and installed 200 amp service, split between the garage and the house, added a ton of insulation to the walls and ceilings, installed all new top-of-the-line windows, completely stripped the old exterior of the house and added  board and batten siding in its place and added both air-conditioning and a new high efficiency furnace. The house has settled and there are cracks in the wet-plaster walls and ceilings. Last summer I patched and sanded and put in new doors and replaced all the old trim in the spare bedroom. Had I hired it done, it would have cost at least $1,500.

All told, the renovations added a great deal to the value of the home but only about 15% to the taxes.

But I haven't done a thing to the kitchen.

What Eileen Hart has done is to add fuel to the "all gun owners are crazy hotheads" argument. She hasn't gotten her taxes lowered. She hasn't stood up for her 2nd Amendment rights. All she has done is show her ass. 

And, with that, I rest my arguments. Make what you will of them. I promised to respond no more and I intend to keep my promise. I am a gun owner ... but I'm not a hot head ... and I won't defend someone who acts the fool. 

Keep your powder dry, your eyes open and your wits about you. Live long and prosper.

The lady quoted the Constitution and I am guessing the Declaration of Independance.  There are a bunch of harsh words when the bureaucrats violate   people's "God given Rights".  In this instance, a contracted company was doing the durty work, and over reacted.  Read the beginning of the story.  If you think all the woman needs to do is get a lawyer, think again.  She better come up with $10,000 or $20,000 for the start to get the crooked lawyers going, and more later.  Even if she wins the court case, the crooks will just go bankrupt and open a new company and do the same thing.  I hope she goes Federal suit and claims civil rights violation.

Joe, I'm not saying that she is definitely lying ... just that it seems odd that she went in there reading from the Constitution during a hearing that is usually based, solely, on financial documentation. She is not being taxed without representation and she does have the right to appeal the assessment. Did she have guns at that meeting? Here in NC, that is a big no-no and could easily result in her losing all of them until this stuff gets sorted out. At any rate it is highly likely that security cameras caught the whole thing on tape and the truth of the matter will get sorted out soon enough. Somebody -- she,  her attorney or Fox News -- needs to file a FOIA request for those tapes.

Different states have different laws so I'm not certain what applied where she is, but that is what would happen in my neighborhood. I have a CCL and I am careful to pay close attention to where I carry and where I do not.

Now, as to the weapons, I can't say whether the cop was trying to intimidate her or just pass along some friendly advice based on experience with the courts and the DA's office but, without a warrant based on probable cause, he had no right to seize the firearms. As it was, they were NOT seized ... he asked and she complied -- no need for a warrant. Roadside searches of vehicles usually operate about the same way. 

Ria, I agree that things are not the way they should be with cops, etc. But every case has to stand on its own merits. I recently took part in a "bull session" in a local gun shop. One of the participants was a local officer. Based on what he had to say about current events, and the tone of voice he used toward some of his fellow officers, I am not prepared to paint all cops with the same paintbrush. It is harder to be selective in our wrath and mistrust, but if we want the Oath Keepers to stand firm in their commitment, we need to make that effort. So, please understand that I am not asleep. If anything, I am far more alert than I have ever been to what is happening around me. I am also alert to keep friends as friends and not make enemies of friends, but make friends of enemies where I can while treating those determined to do me harm exactly as the occasion warrants. Read it slowly and it will make sense.

I am, for instance, watching the situation in the Flatbush neighborhood of Brooklyn, NYC, NY very closely. Did the kid pull a gun on the cops? Did he pull the gun before they began to fire or after he had been shot in the back three times? Was the kid totally unarmed and the shooting totally unjustified? I understand the situation in Flatbush; I've been there. It is like the neighborhood in Detroit I left a little over a year ago.

I do not know this woman. I do not know the others involved. I am not prepared to support her - or them - without more evidence. It can be difficult to sort substance from hyperbole and outright lies, but I can think of no time in the history of our country when we have needed to show more discernment than the present. The last thing I want to do is find myself entrapped into supporting something that I don't agree with based on a lie. 

And no, I never believed in the WMD and I am more certain than most that the WTC was an deliberate demolition.

More proof nobody really owns their home.  The mortgage  papers even call us a tenant.  Triple property tax and who owns their home then?  Only those who can pay the extortion.

Oh, C'mon...is it really too far fetched to think that the cops and the authorities played foul in case of this incident? With countless unlawful arrests and assaults on commoners, by the cops, I don't think so. One doesn't even need to go too far back; in the last 6 months alone they have arrest so many people for no rhyme or reason. In fact, in just last year alone, there have been so many cases involving cops and innocent, faultless people who have ended up in the hospital and, sometimes, even died as a result. 

Though, Judaism nominates the man as the head of the family, nowhere does it prohibit a woman from putting her point across and, I guess, that's what she was doing.

Umm guys ... all we have at this point is a story from one person. IE: one side of the story.

If she's telling the truth, it'll be in the videotapes and her attorney, instead of just defending her, will go on the offensive.  I suspect that she's "cleaned up" her part of the conversation somewhat. Normally you don't go into a tax review reading the Constitution. You go in there with an independent assessment (which many real estate companies provide for little or nothing) along with something called a "competitive market analysis". Then you hammer things out in black and white based on real numbers.

More than that, since her husband was present and she is such a religious person, why was she doing the talking? Judaism, as I understand it, nominates the man as the head of the household.

Just another example of government workers overstepping their authority, then the Gestapo going nuts.  I hope the judge loses the next election, as well as the DA.  I wish this happened closer to me, then I would help picket and bring in honest people in the next election.
