IRS wants 4,000 new agents, $300 million budget to enforce Obamacare

(NaturalNews) More than quadrupling an estimate it put forth last year for new agents (http://dailycaller.com), the Internal Revenue Service (IRS) now says that it will need more than 4,000 new agents to enforce the provisions of the Affordable Care Act (ACA), also known as Obamacare. And in addition to these new agents, the IRS is also asking for more than $300 million in new funding to help fortify the infrastructure it will supposedly need to unconstitutionally force Americans to purchase government healthcare.

The constitutionality of Obamacare is currently being reviewed by the U.S. Supreme Court, and yet the IRS is already acting as though the overhaul is definitive law. According to IRS budget requests, the agency says it needs a massive cash infusion to "continue the development of new systems and modifications of existing systems required to support new tax credits." But in reality, this money will more than likely be used to spy on Americans and fine them for failing to purchase adequate health coverage.

"Health reform's insurance mandate says if you do not have 'adequate' insurance, you'll have to pay a fine as part of your tax return," writes Elizabeth MacDonald for FOX Business (http://www.foxbusiness.com). "If your business doesn't provide 'affordable' coverage, you'll have to pay a fine to the IRS, too, as part of your tax return filing."

According to FOX News analyst James Farrell, new IRS reporting requirements under Obamacare, should it end up being declared constitutional, will require individuals to disclose personal insurance plan information such as coverage provisions and costs to the IRS. The provisions will also require individuals to reveal whether or not they have been offered health insurance by their employers, and what this employer-sponsored insurance costs, information that the IRS has never before dealt with.

Another stated reason for the increase in agents and budget funds is to enforce the new tanning excise tax. Tanning salons, health clubs, beauty parlors and other businesses that offer tanning services will be required to pay a tax similar to the kind levied on alcohol and tobacco (http://blog.heritage.org). According to The Daily Caller, the IRS is planning to devote 81 of its agents just to collecting this ten-percent tax (http://dailycaller.com).

ALEXANDRIA, Va. — ObamaCare is unconstitutional down to its very DNA.  The U.S. Supreme Court can save itself and the country years of litigation by striking down the entire law when it issues its decision this summer.

Two key provisions in the health overhaul law are being challenged in current case — the individual mandate and mandatory Medicaid expansion.

INDIVIDUAL MANDATE :

ObamaCare requires virtually everyone in the country to have health insurance starting in 2014.  This is the first time the federal government would require private citizens, under penalty of law, to spend their own money on a private product.  While there are subsidies for some, the policies will cost an average family as much as $20,000 by the time ObamaCare is fully up and running.

Never before has the Commerce Clause of the Constitution been used to compel private citizens who simply want to mind their own business to spend their own money and compel them to engage in commerce.

A new ABC News/Washington Post poll found that two-thirds of Americans say the court should throw out the whole law or at least the individual mandate, showing the depth of public opposition.

The individual mandate should be struck down because it isn’t protected under the Commerce Clause.

MEDICAID EXPANSION:

The law also requires states to expand their Medicaid programs to cover families earning up to $30,000 a year.  Lawyers for the 26 states that are challenging the law will tell the Court during oral arguments this violates the Tenth Amendment’s protection of states’ rights.

Medicaid, a program designed to pay medical expenses for the poor, is the largest health program in the country. Its costs already are drying up spending on education, roads, and public safety.  Many states warn this huge Medicaid expansion could send them into bankruptcy.

The Medicaid mandate should be struck by the Court as a violation of the Tenth Amendment.

The Court could strike the whole law as unconstitutional since it does not contain a “severability” clause.  Severability would have left the rest of the law in place if any one part is declared invalid.  But most observers believe the more likely scenario is that the Court would imply severability, possibly striking just the individual mandate but leaving most of the law standing.

Then what?

Look for lines to form at courts across the country with future challenges.

For example, the U.S. Conference of Catholic Bishops has warned it will sue to protect its First Amendment rights to religious liberty.  The bishops say there is simply no way that Catholic hospitals, universities and charities can comply with an Obama administration mandate requiring them to provide insurance policies that cover sterilization, contraption and drugs that cause early abortions.

The bishops say this would force them “to violate their own teachings within their very own institutions.”

Separately, the Goldwater Institute in Arizona is suing over ObamaCare’s Independent Payment Advisory Board, the rationing board that gives unprecedented power to 15 unelected and unaccountable bureaucrats to make spending decision for Medicare involving hundreds of billions of dollars.  The Constitution, under Article I, grants that power only to the people’s elected representatives in Congress.

The list could go on — and does.

ObamaCare bashes into the Constitution at every turn because it is fundamentally in conflict to the essential founding principles of this country — freedom and the sovereignty of states and citizens.  It turns control over one-sixth of our economy to the federal government, ceding life and death decisions to the state.

ObamaCare is wrong for America, and the sooner the Supreme Court overturns it, the sooner we can get on the path to patient-centered reform that fits our economy — and our Constitution.

The Internal Revenue Service wants to add about 4,000 agents to hunt down tax cheats and still plans to spend $303 million building a system to oversee Obamacare even though its future looks bleak in the U.S. Supreme Court.

A new Government Accountability Office review of the IRS 2012 tax return season and the taxman’s fiscal 2013 budget request also found that the agency’s customer service rating has slipped and 5.5 million returns were delayed a week because of a computer programming glitch.

The news isn’t all bad though. A March 20 GAO performance audit found that the agency has seen a steady increase in e-filing and had processed 68 million returns so far, a 3 percent bump. What’s more, IRS Commissioner Douglas Shulman said that the American Customer Satisfaction Index for his team has jumped to 73 percent and he added that for every $1 spent on enforcement, the agency collects a return of $4.30.

The audit looked at everything from customer service to pending budget issues. It found that the agency’s “level of service” via phone calls dropped from 70 percent last year to 61 percent currently, and that the number of “abandoned (calls,) busies and disconnects” jumped 41 percent this year and almost 150 percent since 2009. The average wait time for IRS help also surged 48 percent to 16.6 minutes.

As for the new workers sought, the GAO said the total will be about 4,500 with nearly 4,000 slated for enforcement. The IRS, however, argues that past budget cuts have forced the agency to cut jobs and set a hiring freeze. On the $303 million for Obamacare, the GAO said it will “continue the development of new systems and modifications of existing systems required to support new tax credits.”
