@Consciencious Objector, that's true about circumstantial evidence.  Occasionally, it's overwhelming as in the Scott Peterson case.  The three strikes law should only apply to violent offenders and not cluttering up the already overcrowded prisons with 3-time petty thieves.

Aw Lynn, they listen, they just fail to respond sometimes, esp with Newbies.  They will get to know you soon enough. 

The three strikes is very controversial, it's just too harsh for non-violent crimes.

I totally agree with the appeals process but don't know why it takes so long...really...decades.

Nikki:  About  people  being  on  "Death  Row"  so  long.  Because  it  is  the  appeal  process  that  keeps  them  there  so  long.  If  we  were  on  Death  Row  wouldn't  we  want  the  right  to  appeal  it?  It's  the  Judges  decision  to  re - read  all  the  evidence  to  begin  with.  And  they  are  so  busy  that  it  takes  that  long.  There  should  be  a  'Panel'  set  up  to  deal  with  appeals  Only!!  Is  the  "Three  Strikes  Your  Out"  still  in  effect  in  California  (even  that  didn't  work!)

He  does  have  the  right  to  view  all  evidence  concerning  the  case  if  he  is  acting  as  his  own  Lawyer.  But,  a  person  defending  themselves  has  a  FOOL  for  a  Lawyer.  He'll  never  win  this  case!!!  It's  too  high  profile  and  pedofiles  are  hated  -  everywhere....  The  statistics  on  how  many  are  murdered  is  staggering,  upon  release.  And  they  are  never  in  the  General  Population  in  prison.  Other  prisioners  hate  them  as  well!!

Even when found guilty, the appeals process takes decades.  California is saying they will have to do away with the death penalty because they can't afford to keep people on Death Row.  Why must these appeals take so long?  I do agree that everyone should have the right to an appeal, but must they drag it out for so long?

Before we get hot under the collar, we need to remember that he is 'accused' of this crime. In this great country, one is presumed innocent until proven otherwise. Let's keep it that way. Go back to your tabloids and Penthouse magazines and chill out.
