Judges' ability to "perfect" the record (strike things that are said) and unlimited ability to throw out evidence and jury findings, etc., make for severe injustices. Also, the use of contempt of court on an assembly line basis, to levy jail time in cases involving Temporary Protection Orders are some of the most blatant and hoary unconstitutionalities.

The system of plea bargains is also no doubt very unconstitutional. Thomas Paine said that if we don't have a check on the judiciary's power, we will find them ruling over all of us. Apparently nobody listened to him, and they pretty much do rule over us.
