Subject: We really need a seriously strong show of support for Arthur (Jay) Hirsch
By now most of you have heard of the unlawful arrest and jailing of Arthur Hirsch on private property in Ardmore, Alabama at 12:15 A.M. on July 26. He was charged and jailed for a misdemeanor offense of carrying a concealed weapon (.22 cal, 5 round revolver) without a permit. Prior to the August 23rd court hearing, Mr. Hirsch filed a Notice of Jurisdictional Challenge and Demand for Dismissal. The Judge ignored the demand for dismissal and the question of jurisdiction and proceeded to swear in all potential witnesses, but Hirsch refused to cooperate because the Judge hadn't answered his jurisdictional challenge. In an obvious attempt to get Hirsch to agree to be sworn in, he promised Mr. Hirsch two or three times that he should go along with the simple process of being sworn in because, and he said, "Look, I'm not going to put you in jail over this if you'll just get a carry permit." Mr. Hirsch continued stoically to stare into the judge's face and not say a word. In a bit of frustration the Judge eventually called an end to the hearing and rescheduled it to be continued on Sept 23rd.
Ladies and gentlemen, this case does not begin and end with simply a challenge to the unconstitutional statutes requiring us to apply and pay for a permit to keep and bear arms. This is about challenging all unconstitutional statutes that our servant governments have dreamed up, and continue to dream up. Statutes are written to eliminate our natural, unalienable rights to life liberty and the pursuit of happiness. Just a few examples of other unconstitutional statutes we live with everyday are: Buying a license to own a dog or cat, a requirement to wear a motorcycle helmet, restrictions on building our own house, requiring our children to attend public schools, prohibiting public prayers, licenses to hunt, licenses to fish, licenses to be a beautician or barber, licenses to do just about anything you can think of, and every time we pay for a license to pursue our life, our liberty and our pursuit of happiness, we reinforce our servant's collective presumptions that we the people have no Constitutional rights, we have only statutory privileges. Consequently, everyone of us, including our children and grand children have a major stake in the outcome of the trial of Arthur Hirsch on September 23rd in Ardmore.
At the first hearing for Mr. Hirsch, the Ardmore Chief of Police really impressed all of us with his well armed show of his presumed dominance. His entire police force was on hand and geared up for what they said was, "a perceived threat". One officer was dressed in a spiffy swat uniform, brandishing an M-16 military assault rifle. On September 23, we hope to have a crowd of at least 100 people from Alabama and Tennessee to appear at the Ardmore municipal courthouse with a strong show of solidarity for the cause Mr. Hirsch has committed to fight on our behalf. If you have a lapel button that says, "WE DARE DEFEND OUR RIGHTS!", please wear it. If you don't have one, we plan to have an ample supply of them to hand out. The court room cannot possibly seat everyone, but our presence will send a powerful message that will be seen and heard far and wide. We would be thrilled to see a crowd of two hundred or even three hundred supporters show up. Rest assured, that would have far more effect than the swat man with the M-16. If you cannot possibly make your own physical presence, please try to have someone come on your behalf. We need all the help we can muster.
