There have been cases where the individual with HIV HAS disclosed their status, but the newly infected will file charges anyway. 

Proving non-disclosure is nearly as difficult as proving disclosure, it's one persons word against another. 

Any THINKING ADULT who does not protect THEMSELVES during risky behavior (i.e. positing all partners are infected regardless of disclosure or not) is guilty of stupidity.

If you know you have HIV, and you have unprotected sex without warning your partner in advance, you are guilty of Murder 1.
