This morning, the Colorado House passed “Red Flag” legislation, House Bill 1177 by a 38 to 25 vote. HB 1177 will now be transferred to the Senate for further consideration.  Please contact your state Senator and urge them to OPPOSE HB 1177.

This legislation is being pushed by New York City billionaire Michael Bloomberg and his anti-gun groups/affiliates.  HB 1177 would create avenues for individuals to petition the court to take away your civil liberties without due process.  Further, HB 1177 would force you to prove that you are not a danger to yourself or others in order for you to recover your personal property.

House Bill 19- 1177: Extreme risk protection order or "red flag" legislation sponsored by Majority Leader Alec Garnett (D-Denver), Representative Tom Sullivan (D-Centennial), and Senators Lois Court and Brittany Pettersen, would authorize the seizure of firearms from individuals without due process.  The petition can be originated by a broad class of individuals, to include roommates and anyone you've had an "intimate relationship" with.  Unchallenged statements made by a petitioner before a judge, alleging that someone is a danger to themselves or others in an ex parte proceeding -- prior to any formal court hearing at which the respondent can be represented by counsel and present counter evidence -- would be sufficient for law enforcement to enter that person's home and confiscate their private property.
