Knowing Your 4^th Amendment Rights when dealing with the Police

I speak from experience I’m an Ex Deputy, and I’m tired of seeing people’s rights being trampled on! First A Police Officer must have Probable Cause when pulling you over are stopping your freedom of movement. That means check points violate your rights as they stop your freedom of movement with no Probable Cause. Probable Cause sufficient reason based upon known facts to believe a crime has been committed or that certain property is connected with a crime. Probable cause must exist for a law enforcement officer to make an arrest without a warrant, search without a warrant, or seize property in the belief the items were evidence of a crime.

Even if the Police have Probable Cause to pull you over (Traffic Violation) you still do not have to agree to a search of your Vehicle. The Police still have to have Probable Cause to search your Vehicle. Pulling you over for speeding or running a stop sign is not Probable Cause for searching your vehicle. The Police must have Probable Cause to search your Vehicle period separate from a Traffic infraction period! If the Officer asks if he can search your vehicle you have the right to say NO! He might come back and ask you “What do you have to hide?” Don’t fall for this trick! Why should you have to prove to the Officer you have nothing to hide if you have not done anything wrong! Stand up and tell the Officer Politely No and that he will have to provide a Warrant to search your vehicle. Being an Ex Law Enforcement Officer 9 out of 10 times they will drop it as most Police Officers are lazy and they really have no probable cause to search your vehicle. However They can get a k9 dog in place of a warrant, and if he reacts to your vehicle that gives them the legal right to search your vehicle. But be aware that most  Police Departments have limited resources and a K9 Unit is not always available. This is also a loophole they use to avoid getting a Warrant. Don’t let them intimidate you! Most Police Officers are bullies and feed upon people who will not stand up to them! I know I worked with these people and know how they think.

 "Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

If the Officer asks you if you were speeding you do not have to answer this question. Politely tell the Officer that you are not required to answer this question, and that you have a fifth Amendment Right not to answer it. This is an old trick by Police to get you to admit to guilt. Remember you’re being recorded with video and audio during this stop.

! Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

Always follow traffic laws, but remember you have Rights DO NOT LET THEM BULLY YOU! THEY HAVE ALREADY CONDITIONED MOST OF THE SHEEPLE OH I MEAN THE AMERICAN PEOPLE TO LICK THEIR BOOTS! UNTIL AMERICANS STAND UP TO THESE BULLIES WE WILL CONTINUE TO LOOSE OUR RIGHTS AND WHAT LITTLE FREEDOM WE HAVE LEFT!
