I agree and do NOT approve of forcibly taking "Blood", but when a refusal occurs, that person gets arrested and put in jail pending other procedures.

Yes writing a good report with ALL the observable symptoms will help and a video of the FST, noted dilated pupils, slurred speech, failed coordination tests, the smell of an alcoholic beverage about the body or breath unless it is narcotics. Then the symptoms are different. 

I even had on guy who could recite the alphabet backwards!!(He was on Marijuana!)

A Hearing occurs in a few months and the driving privilege is REVOKED Automatically until a DMV Judge decides to reinstate or revoke the license. 

It is NOT a RIGHT, but a privilege.

You signed an agreement to obey the traffic laws, and rules of the road and any violation is a revocation of your license if it is severe enough, otherwise you get a "Ticket".

I was a Deputy in Texas, and I also made several arrest for DUI's and was also certified. I don't drink or use drugs, but I don't agree with forcibly taking blood from the Suspect. Their still American Citizens have the right of due process, and should be able to refuse to help the State to convict themselves! I agree drunk driving is STUPID, but this use to be America, and you should still have the right to say NO! They will still be arrested and taken off the streets regardless if they say no or yes.  If you write a good report in document everything, and you have them on film believe me they will convict themselves without stepping on the U.S. Constitution to do it!

I was a State Certified Police Officer In California from 1978-1981 before going to another agency. I made numerous arrests of DUI or combinations and was certified as a DRE expert as well.

Failure to provide a blood, breath or urine sample is a requirement of your "Privilege" to drive and your drivers license shall be "revoked" for a period of 6 months upon refusal when YOU are suspected of driving under the influence.

Therefore, it is expected that if you refuse, you can be forced to give blood especially if there is "Criminal behavior" involved or criminal charges resulting in the person's driving under the influence.

If there is a recent decision since then I am not aware of it.

I do NOT drink or use drugs and am not affected by the requirements of driving or it's laws.
