Charges against Michigan Hutaree militia thrown out, All free except 2

DETROIT — A federal judge on Tuesday gutted the government’s case against seven members of a Michigan militia, dismissing the most serious charges in an extraordinary defeat for federal authorities who insisted they had captured homegrown rural extremists poised for war.

U.S. District Judge Victoria Roberts said the members’ expressed hatred of law enforcement didn’t amount to a conspiracy to rebel against the government. The FBI had secretly planted an informant and an FBI agent inside the Hutaree militia starting in 2008 to collect hours of anti-government audio and video that became the cornerstone of the case.

“The court is aware that protected speech and mere words can be sufficient to show a conspiracy. In this case, however, they do not rise to that level,” the judge said on the second anniversary of raids and arrests that broke up the group.

Roberts granted requests for acquittal on the most serious charges: conspiring to commit sedition, or rebellion, against the U.S. and conspiring to use weapons of mass destruction. Other weapons crimes tied to the alleged conspiracies also were dismissed.

“The judge had a lot of guts,” defense attorney William Swor said. “It would have been very easy to say, ‘The heck with it,’ and hand it off to the jury. But the fact is she looked at the evidence, and she looked at it very carefully.”

The trial, which began Feb. 13, will resume Thursday with only a few gun charges remaining against militia leader David Stone and son Joshua Stone, both from Lenawee County, Mich. The Hutaree Case: Next Time, They'll Just Send In The Drones

Next time the Regime identifies a group of people as “domestic terrorists,” the result might be summary execution, or imprisonment in military custody, rather than a trial. This is one very plausible result of the dismissal of “seditious conspiracy” charges against members of Michigan’s Hutaree militia.

Thanks to the legal environment created by the NDAA, the Feds won’t have to run the risk involved in submitting the next “domestic terrorism” case to the scrutiny of a court. Now that Attorney General Eric Hoder has helpfully clarified that “due process” and “judicial process” aren’t the same thing, it’s entirely possible that the next group of American dissidents identified by the SPLC or other self-appointed political watchdog groups as “terrorists” could be targeted by a drone-fired missile or a presidential strike team.

@ Hugh:  Judge Earl Johnson, Jr.:  "Poor People have access to the courts in the same sense that Christians had access to the lions."

Glad to see that a few judges are above just hanging everyOne on principle.  There is hope.

It is about time, those dadgum judges got those law books out and read 'em , so they can understand that the Prosecution ,don't sufficent evidence for the charges! And just Think they Prolly Got through Law School with Grants and Loans ,that they are charging out the wahoo in their offices , Public Servant ,My Cat behaind.....I for The Hutaree....

What happened to the 6th Amendment?

"In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."

In sworn testimony, Thomas William Piatek is described as a Cooperating Witness and an undercover FBI agent. Thomas William Piatek is pictured at the bottom right. It is interesting to note that, unlike the other suspects, he appears not to be wearing a jail uniform. “A spokesperson at the FBI’s Detroit office declined to comment on the undercover agent and any role such an agent may have had in the investigation. A spokesman at the Justice Department in Washington also declined to discuss specifics of the investigation,” the Journal reports. It is not surprising that the FBI had penetrated the Hutaree group and an agent was apparently at the center of the alleged conspiracy. In fact, it is part of a well established pattern.' We live in a country now that can imprison you for 2 years on bogus charges and ruin your life at it's own will. further more YOU ARE LUCKY IF YOU GET OFF THAT EASY! Most Judges would have chickened out and sent it to trial where they would have found the most retarded jury they could get their hands on and railroaded them into life in prison.
