Arrested in Virginia by the State Police for trying to Legally Purchace a Handgun!!! Please Post your honest opinion's!!!!

Around the first of the year I was with my youngest "21" sister and we attended the Dixie Classic Gun & Knife Show. We look around at many gun's talked to some great people about gun's and political view's. Later that day it was wrapping up i found a handgun i was very much interested in. After completing the application, 100% honestly to the best of my knowlage, i turned it in to the back round check. Very excsited about buying my handgun, waited around only to be told that the application did not go thru in time, that they would give me a call asap, after application was accepted or denied. A few day's went buy, and i got a call from the dealer at my house that my application was denied. So upset and frustrated i asked why, exsplained to the dealer that i was not ever charged as a felony, anywhere in my life, that i was legally registered to vote, and there was no domestic violence in my life. I was told by the dealer that i would have to call the state police and they would be able to exsplaine to me why i was denied. I contacted the VA State Police and after many call's was informed that i was denied because i was involuntary hospitalized in 2001. I thought back to 2001 and was a VICTIM OF A CRIME IN 2001!!! I was held at gun point then bashed upside my head to unconciusness, then sat upon and beat repeaditly in the face over and over till i was nearly dead!! I was on life support, for nearly a week, and my mother was told i might not make it. Now this is the only time in 2001 i was hospitalized, and i was a victim of a crime committed aginst me. "Now about 2 week's later after i call the state police to find out why my right's were denied, and what i have to do to restore what should have never been takin, "with out my knowlage" I get a call from state trooper saying he got a investigation on his desk that i tried to purchase a hand gun. I did not deney that cause i had no reason too, went on to exsplane that i tryed to buy it legally and the the only time i was hosptalized in 2001 was due to a crime aginst me, I swear on my life to the good lord above he asked when we could meet to talk more, stating to me that he was going to help me restore my right's to purchase the handgun i wanted. I proceeded a "WEEK LATER" to meet him at where "GREENTOP GUN'S AND TACKLE", I go on tell him that witch i have told you in this article to only be took out the car and charged with a class 5 Felony 18.2-308.2:2 (willfully and intentionally make a materially false statement on the consent form, required by subsection B or C of 18.2-308.2:2.) As well as class 1 Misdemeanor 18.2-27/18.2-308.1:3 ( attemp to purchase, a firearm after having been involuntarily admitted to a facility.)

Now i can say that i

#1.DID NOT walk into the gun show, knowing i cant leagally buy a gun.

#2. After being Denied called the state police to find out why i was denied and what i have to do to have my right's restored.

#3. Was lied too and manipulated by a state officer.

#4. Who is going to try to buy a gun illegally in a place filled with police and mandetory backround check's, and then follow up with my own right's only to be manipulated by the Virgina State Police.

Please share your input on this matter, cause at this point i am facing Jail time, Fine's and a Felony!!! I aint no felon and dont deserve to be labeled as one. Thank's for reading this and i look forward to hearing your input, from all.

That's pretty rough man, but you should have talked to your lawyer before meeting with state police, especially under those circumstances. Almost anyone would have done the same thing, especially after being essentially told the cop was on your side. I hope it is all sorted out soon and without further incident.

can clearly see your stay at the hospital is not relevant. You should sue the state officer for wrongful arrest. good luck.

Hmm, here in the UK, it's virtually impossible to buy a gun...you have to join gun club etc., and very few have them...I understand it's your right over there in the US, part of the Constitution and all that;

Let's look at it from both sides, the cops don't want you/us to have guns, as the elites know if all armed we'd soon sort the fuckers out...I'd love some guns;-) - But besides that, - what happened to you sounds real nasty, must have been a mentally disturbing ordeal...such an experience can either make or break you, it would break most...so you've done well to get this far. They could view it as if you might wish to seek revenge on those who did that to you, and they feel they could be sued, if they were to let you easily be able to purchase a gun, so basically they're covering their own arses, asses in your case!! - What that pig try to do to you, could be viewed as "entrapment", - he got you to come and met him so under false pretences, - though because he had your application form, where they are alleging you filled it out intentionally making a false statement, and that this is an offence etc. Well go tell them to go fuck themselves!! No, no, no...don't do that, but that's how we feel right ;-) Haha..., Look, you tell the court, you filled in that form to the best of your sincere knowledge, you did not intentionally make any false statement; your understanding and concept of the question; "having been involuntarily admitted to a facility" - did come into mind as to when you was, as after all and like you've said; you were the "victim", - it's not as if you were certified for having a mental condition, no, you were a victim, hospitalised for you had no alternative due to being attacked, - so like I say tell them to go fuck-off, no, no, no don't do that, but that's how we feel right!!!

I have to agree, never talk to cops without a lawyer. I'm just curious - why do they consider your hospitalization to be 'involuntary'?

When dealing with cops always remember, never give them any information especially if they seem to be inquisitive. Do not answer questions, ask them. Like, "Are you arresting me officer" or "Am I being detained?" or "Am I free to go?" Asking a question is not giving them information and can be non confrontational. Be in control of the conversation, use only questions and say nothing else.

In this situation, get a Lawyer, it sounds like the law is pertaining to criminals that have been shot or badly assaulted. Criminals do not go to the hospital if wounded, they would most likely be turned over to the police by the Hospital staff, in fact, most Hospitals have to report any suspected physical violence to the police. This may have been the case with you being assaulted. And always remember, we live in Napoleonic Times where you are presumed guilty until proven innocent, at least that is how the cops view it. So when dealing with the police do not be friendly, be professional and keep your mouth shut. Cops are the most frightened people in our modern day America. We all know how many people hate the police and the police know this, then ad the fact that on rare occasions they are embroiled in violent altercations. Always be disarming by doing what the officer says and do it quickly. Show no signs of agitation or fear. Cops are innately trained to smell fear like dogs and that makes them aggressive. It becomes an instinct with long term police careers. And finally, know your rights, if, as you had in this instance, have time to investigate the situation before you proceed, do so. Alarm bells should have gone off when you found out you were denied.

How do I know this? I have been arrested for misdemeanors, jailed and harassed by police because of profiling, hand-cuffed and sat on a curb while the officer rummages through my car. I was profiled because me and my friend had long hair, drove a Camaro and pulled out of a bikini bar when they pulled me over. We fit the profile of a drunk or speed freak. They let me go because I did not have drugs, was not drunk, politely obeyed and had all my papers on me. In most states if you are on probation they do not even have to suspect you they can search your car which also had happened to me. Again, they found nothing to incriminate me. The police are going broke like everyone else so they are looking for ways to make money through nefarious means. Be alert, careful and try not to draw attention to oneself.

I personally will NEVER buy a gun legally.. in a system bent on tyranny .. why let these massive bastard NAZI back stabbing Moytha plukin pig croch sockers know anything we do!! this sh*t is on!! Never Never Never obey an illegal law that goes against the constitution ... which they all are traitors of every second of every day... Fuk them that is why there is a black market .. I drove 4 days and a thousand miles to get what i wanted from a private sale.. and hid my stuff so nobody knows accept me where it is ...

I hate the enemies of freedom, they will pay for every every inch of freedom stolen. If i had it my way they would swing from there phalic symbols and bleed out ..

Contact your state senator, your national congressman, your city council, your mayor, your county sheriff, and anyone else who is legally required to interpose on your behalf against tyranny. One or more should help you or be exposed.
